Minutes of Meeting

held at 10.00 a.m. on Friday 16 July 2010

in the Council Chamber, Áras Chill Dara.

Minutes and Progress Report

The committee considered the minutes of the monthly meeting held on 18 June 2010. Resolved on the proposal of Councillor Purcell and seconded by Councillor Mc Ginley, that the minutes be confirmed and taken as read.

 

 

Taking in charge of Ralph Square

Councillor Murphy asked when this estate would be taken in charge and that the members get a copy of the land survey, she also requested that this item remain on the agenda for the September meeting.

 

 

Pilot Scheme on regulation of Shop Signage

Councillor Purcell was disappointed with the report from the planning department, he stated that there was no point in the members spending money on towns if the problem with shop signage was not regulated, he asked if the planning department would investigate their concerns if the members supplied pictures to them. Councillor McGinley suggested that the environmental officer may be able investigate the matter also; Councillor Murphy reported that sandwich boards were also a concern and asked that these also be investigated.

 

 

Taking in charge of Castledawson

It was reported that building control were not aware of the developer's view with regard to having this estate taking in charge.  As stated in a previous report the taking in charge of Castledawson could not be considered until the pumping station in Newtown Hall was taken in charge. As Newtown Hall estate was unlikely to be completed and taken in charge for some time, building control section would contact the developer of Newtown Hall with a view to taking in charge the pumping station in advance of the remainder of the estate. Councillor Murphy asked if the developer had been contacted in relation to this matter.

 

  

Taking in charge of Oldtown Mill, Celbridge

At the June meeting the committee considered the following motion in the name of Councillor Murphy:

What remains to be done prior to taking Oldtown Mill in charge, could it be taken in charge in increments?

The planning department reported that the members should consult the report on Private Residential Developments (2006 to 2008). The taking in charge of Oldtown Mill could not be considered until St. Raphaels was taken in charge. The meetings administrator said he would speak to the planning department and reply to the councillor in writing.

 

 

Celbridge Renewal Scheme

At the June meeting the committee considered the following motion in the name of Councillor Murphy: We ask for a report on what remains to be done on the Celbridge Renewal Scheme that the outstanding items are costed and we consider if some of the work could be done on an incremental basis.  That any planning permissions given in the vicinity of Main Street would contribute towards the project. It was reported that the roads construction section had been asked to estimate the cost of the outstanding works.  However, considering the extremely constrained financial environment it was highly unlikely that funds would be available to progress these type of works in the near future.

With regard to the imposition of a special levy on new planning permission granted in the vicinity of the Main Street it was suggested that this matter should be considered in the context of the review of the Development Contribution Scheme. An Cathaoirleach asked that the planning department prepare a further report as the reply given lacked clarity.

 

 

Pedestrian crossing at the Church of Our Lady’s Nativity, Leixlip

A letter was read out at the June meeting from campaigners in favour of the pedestrian crossing at the Church of Our Lady’s Nativity, Leixlip, the letter thanked all the members who had contributed their discretionary fund towards the installation of the pedestrian crossing. The members requested that the roads department reinvestigate this location.

 

 

Traffic Management, Kilcock Road

Mr D. Hodgins of the trafiic management section attended the meeting to discuss the current plans for traffic management on the Kilcock road which include a cycle lane, Councillor McGinley was not in favour of the implementation of a cycle track as he felt that it would be rarely used, he did however agree with the improvements planned at the school on the Dunboyne road, Councillor Kelly supported most of the plan. Mr Hodgins stated that he was waiting for funding from NUI Maynooth and the National Transport Association for this scheme and would return to the September meeting with a further update.

Representative from Dublin Bus

Mr Gareth Quinn and Mr Ray Coyne from Dublin Bus attended the meeting to discuss the 66 and 67 bus routes in the North Kildare area, Councillors Mc Evoy and L Doyle from the Clane area committee were also in attendance. The members received a plan of the proposed terminus for the extension to the 67 route; however they were not in favour of the current plan to install it within the estate as buses with engines running would cause noise and pollution problems for residents, councillor McGinley stated that he had hoped that the turning point would be on the new road. Mr Quinn stated that a definite decision had yet to be made and that Dublin Bus were looking at the two options available to them for the terminus. Councillors McEvoy and L Doyle were very unhappy with Dublin Buses decision to discontinue the 66 route to Kilcock as the population in this town had increased dramatically over the past few years. Mr Coyne reported that this service is not being used by the local people and therefore not viable to run. Councillor Doyle stated that the service is required and that Bus Eireann have plans to extend their service from Kilcock. Councillor Griffin reported that the ramps on the Moyglare road would need to be removed in order to accommodate the buses and that new traffic calming measures would need to be installed; he also requested that the NTA be invited to the next meeting to discuss the discontinuation of the 66 bus to Kilcock, Councillor McGinley suggested that the Minister of Transport also be invited to attend to discuss this issue. Councillor Murphy asked who would fund the required changes to infrastructure to accommodate the extension to the bus route and if the NTA contributed funding, Mr Quinn stated that as far as he was aware it would be the responsibility of the local authority to fund the required works. Mr Hodgins reported that the ramps would be removed and smaller ones reinstalled which would be funded by the council.

Resolved: That the roads department invite the NTA and the Minister of Transport to attend the next meeting to discuss this matter further.

County Kildare Special Speed Limit Bye Laws 2010

An Cathaoirleach asked that all signage be checked to ensure that the correct signs are in the correct jurisdictions. Ms Kavanagh reported that all statutory processes had been completed and that no objections had been received after the public consultation period. An Cathaoirleach extended his sympathy to the families of the eight deceased who were involved in the tragic car crash in Buncrana a few weeks ago, he also requested that this message be passed onto the local authority in Buncrana. He also passed on his condolences to Siobhan Barry and her family on their recent loss.

Pedestrian crossing, Moyglare Road

The committee considered the following motion in the name of Councillor McGinley:

That the pedestrian crossing at the boys national school on the Moyglare Road, Maynooth be improved in line with the wishes of the junior road safety officers i.e. proper road signage, proper road markings, the installation of flashing zebra crossing lights to warn oncoming motorists. The roads department reported that the crossing referred to by the junior road safety officers in their correspondence was an unsignalised crossing which used the existing traffic ramp as a crossing point.  School warning signs were in situ at this location and these signs were in the process of being upgraded.

As previously advised, the traffic ramps were being removed to be replaced with more appropriate traffic management measures to facilitate the use of Moyglare Road by Dublin Bus for their extended services.  The area along the Moyglare Road at the two schools was being examined as part of the Kilcock Road Part 8 Public Consultation Scheme and the correspondence referred to in the motion was being considered as part of the proposals for this scheme which would be discussed at the September meeting.

Resolved: That the roads department return to the September meeting with a further update.

Road signs in Straffan

The committee considered the following motion in the name of Councillor McGinley:

That this council, in line with department guidelines, erects road signs in Straffan Village announcing their successes in the Tidy Towns Competition.  Furthermore that the two missing road signs on the Lodge Park Road and Clane Road be replaced, that graffiti be removed from existing signs and that damaged signs be replaced.

The roads department reported that with regard to the two missing road signs, this work would be undertaken by the area office later in the autumn when the Road Works Programme was completed. The environmental department stated that they would be pleased to erect a sign regarding the success of the Straffan Tidy Towns Committee and asked if the committee could submit a draft design.

Traffic problems, Crodaun Forest Park and Castle Village

The committee considered the following motion in the name of Councillor Murphy:

In view of the difficulty for residents getting in and out of estates on the Maynooth Road, namely Crodaun Forest Park and Castle Village, we seek from the road design department a remedy that is cost effective and can be implemented in the short term.

It was reported that the chief technician would meet Councillor Murphy on site with a view to preparing a design.  However, no works could commence in the absence of adequate funding being identified.

Green Lane, Leixlip

The committee considered the following motion in the name of Councillor Murphy:

We ask that the road as currently designed at the Green Lane entrance to Castletown Estate, Leixlip is amended to reflect the large number of pedestrians who use the route on a daily basis.

It was reported that the chief technician would meet Councillor Murphy on site with a view to preparing a design.  However, no works could commence in the absence of adequate funding being identified.

Road Safety issues, Boys national school, Moyglare Road

The committee considered the following motion in the name of Councillor Murphy:

We consider how the changes can be made to the road conditions outside the boys national school, Moyglare Road, Maynooth in line with those sought by the school and its junior wardens.  They can be summarised as follows; proper road signage and road markings and flashing zebra crossing lights to warn oncoming motorists.

Provision of pedestrian crossing, Maynooth road, Celbridge

The committee considered the following motion in the name of Councillor Byrne:

That a pedestrian control crossing be provided on the Maynooth Road, Celbridge near the Beatty Park bus stop, thus allowing safe crossing of the road for those wishing to use the bus service and in particular those living in the St Raphaels community based home in Beatty Park, Celbridge.

It was reported that there was no funding available to undertake implementation works for traffic signalling projects unless they were to be funded from external sources. Councillor Byrne asked that a design and costing for the required works be prepared, Ms Kavanagh agreed to this but was unable to commit to a timeframe due to current projects.

Resolved: That a costing and design be prepared for a pedestrian control crossing on the Maynooth Road, Celbridge near the Beatty Park bus stop.

Footpath for junction of the Sallins Road/Kill Road at Millbrook, Straffan

The committee considered the following motion in the name of Councillor Byrne:

That a footpath be provided from the junction of the Sallins Road/Kill Road at Millbrook, Straffan to the Morrel Bridge on the Kill Road as this area of road can no longer be used safely by pedestrians or by cyclists.

The roads department reported that Clane area office had no plans to construct a footpath along this section of road as the existing maintenance and footpath budgets were allocated to higher priority schemes.  The only way that this footpath could be installed would be if funds were made available from the Councillor’s discretionary funding.

Extension of Footpath, St Patricks Park, Celbridge

The committee considered the following motion in the name of Councillor Byrne:

That the footpath near house 935 of St Patricks Park, Celbridge be extended in order to prevent three point turns by motorists turning back onto the Main Street, in an area where children are often at play.

The roads department reported that this request had been forwarded to roads design section for consideration.  However, works could not be progressed in the absence of funds being identified. Councillor Byrne asked that a design and costing for the required works be prepared and be funded from his discretionary fund

Traffic calming measures, Moyglare Road

The committee considered the following motion in the name of Councillor Byrne:

The proposal to extend the bus route up the Moyglare Road is welcomed, however, the removal of the traffic calming measures is of serious concern bearing in mind the delay in replacing and the fact that 1600 students are using this road on a daily basis, I call on Kildare County Council to provide traffic calming measures which will facilitate a safe crossing for students/pedestrians.

The roads department reported that the traffic ramps on the Moyglare Road would be removed would  be replaced with more appropriate traffic management measures to facilitate the use of  Moyglare Road by Dublin Bus for their extended services.  The area along the Moyglare Road at the two schools was also being examined as part of the Kilcock Road  Part 8 Public Consultation Scheme. The location of the turning point was indicated on a map supplied to the members at the meeting.

Undergrounding of the ESB cables at Main Street, Celbridge

The committee considered the following motion in the name of Councillor Griffin:

In order to advance the undergrounding of the ESB cables at Main Street, Celbridge, Kildare County Council are requested to apply to the ESB for financial assistance so that this project can be expedited.

The roads department reported that they could apply to the ESB for funding for undergrounding cables if the members wished.  However, it should be noted that the cost of undergrounding would be significant and it was suggested that the ESB would seek matching funding from the council.  Unfortunately, due to current financial constraints it would not be possible to provide such funding for this project. An Cathaoirleach asked that the roads department apply to the ESB in relation to the undergrounding of wires on the Main Street, Celbridge and await their reply.

Petrol Interceptors, Newbridge, Coneyboro

The committee considered the following motion in the name of Councillor Murphy:

What is the cause of the malfunction on the petrol interceptors on Newbridge, Coneyboro, what will it take to overcome the problem?

It was reported that this interceptor was cleaned and overhauled approximately four months ago and was now functioning properly. Councillor Murphy reported that the interceptors had  not been working recently and asked that they be investigated as soon as possible.

Resolved: That the roads department investigate the petrol interceptors on Newbridge, Coneyboro to ensure that they are working sufficiently.

Repair of cycle path on Hazelhatch Road, Celbridge

The committee considered the following motion in the name of Councillor Byrne:

:To ask the council to repair the cycle path on Hazelhatch Road, Celbridge which is in a dangerous condition for cyclists?

The area engineer reported that this matter would be investigated and she would revert to the members at the next meeting.

Resolved: That the area engineer investigate the cycle path on the Hazelhatch Road, Celbridge regarding required repairs and return to the September meeting with her findings.

Replacement of traffic calming measures, Moyglare Road

The committee considered the following motion in the name of Councillor McGinley:

What traffic calming measures will be replacing the two traffic ramps on Moyglare Road and where in Moyglare Hall will the 67 bus turning point be located?

The roads department reported that the traffic ramps on the Moyglare Road that were to be removed would  be replaced with more appropriate traffic management measures to facilitate the use of  Moyglare Road by Dublin Bus for their extended services.  The area along the Moyglare Road at the two schools was also being examined as part of the Kilcock Road  Part 8 Public Consultation Scheme. Improvement of the sight lines at the Clonagh junction, Johninstown

The committee considered the following motion in the name of Councillor Griffin:

In order to improve the sight lines at the Clonagh junction, Johninstown, Kildare County Council are requested to enforce the planning conditions that will make the junction safer for the local residents.

It was reported that this matter had been referred to the enforcement section on 12 July, 2010, for further action. An Cathaoirleach asked that this matter be expedited by the planning department as soon as possible.

Resolved: That the planning department investigate this matter as soon as possible and prepare a further report for the September meeting.

Geraldine Hall, Maynooth

The committee considered the following motion in the name of Councillor McGinley:

That a reply be given to the email, include drawings, submitted by the Scouts architect to planning on the 11 May on their proposal scheme for the Geraldine Hall, Maynooth so they can proceed to planning stage.

The planning department reported that the conservation officer had met with the project architect, on site and relayed his concerns regarding the protected structure which he undertook to incorporate into their planning submission.

Return of Bond to developer, Abbey Farm

The committee considered the following motion in the name of Councillor Murphy:

Why was a large portion of the bond returned to the developer of an estate (details supplied) in advance of the estate being taken in charge, who made the decision to return it and what was the basis for that decision?

The planning department reviewed the building control file and the available planning files for Abbey Farm estate it would appear that the building and development control section made a recommendation that a significant portion of the bond be refunded, retaining £10,000 and appropriate interest "to cover any problems on un-surveyed sewers and underground services" in December 1997. At the time the estate was complete and all surfacing works had been completed satisfactorily.

However, based on the review of the building control file and the available planning files there was no documentation to indicate if this recommendation of a refund of the bond was actually carried out. The building control section had requested the finance section to check their records to establish how much of the bond provided was still available.Any surface defects that had appeared since were mainly due to wear and tear and the lack of maintenance of the estate in the intervening years. A recent CCTV survey of the foul sewerage system, commissioned by the building control section, indicated that the foul sewerage system was working properly and that there was no evidence of any significant defects. It was proposed to take the estate in charge if requested to do so by the residents in accordance with the provisions of Section 180 of the Planning and Development Act 2000 and expend any available bonds on addressing the surface defects identified in the snag list prepared by building and development control section. Councillor Murphy asked that this item remain on the agenda and that a report be prepared for the next meeting in relation to the return of the bond

Resolved: That this item remain on the agenda and that the planning department investigate the return of the bond to the developer and prepare a further report for the September meeting.

Future needs/requirements of schools in Celbridge electortal area

The committee considered the following motion in the name of Councillor Griffin:

Have the Department of Education provided Kildare County Council with updated figures to cover the future needs/requirements (for the Celbridge area) in the primary and post primary sectors?

The planning department prepared a detailed report regarding the Celbridge area. As part of the review of the Celbridge Local Area Plan (which was adopted in January 2010) submissions were invited from the public during the period 18 June – 29 July 2009). A submission was received from the Department of Education and Science during this period. In summary, the submission included the following information

  1. general guidance in relation as to how educational infrastructure requirements should be calculated
  2. enrolment figures in the 2008/2009 school year of 2,349 pupils in the seven primary schools in Celbridge
  3. enrolment figures in the 2008/2009 school year of 1,435 pupils in the two post-primary schools in Celbridge

4.      it was noted that the Draft Celbridge LAP projected a population for Celbridge of 24,192 persons by 2016 which represented an increase of 4,851 persons on the 2009 population of 19,341.

5.      Using the Departments criteria, this increase in population could yield a potential additional 582 primary pupils and 412 post-primary pupils which could equate to the requirement for an additional 24 classrooms at primary level. These numbers could equate to the requirement for a new post-primary school if it is not possible to add this level of accommodation onto existing post-primary schools.

In light of the projected population, the Department recommended that it would be prudent to reserve 2.2 hectares for primary provision and 4.86 hectares for post-primary provision in Celbridge.

While the Local Area Plan did not differentiate between lands being suitable for either primary or post-primary provision, a total of 47 ha of land was now zoned ‘Community and Educational’ in the Celbridge Local Area Plan 2010, an increase of 5.5ha from the Celbridge Development Plan 2002. While these lands are not reserved exclusively for educational purposes and may accommodate a number of other community type uses, the Planning authority considers that these zoned lands along with those lands that were zoned for Educational’ purposes in the Celbridge Development Plan 2002 that had not yet been taken up for educational purposes, are adequate to cater for the educational requirements of Celbridge over the period of the plan.  An Cathaoirleach welcomed the report but reported that he had worded his question incorrectly, he asked that this item remain on the agenda and a further report be prepared to include the entire Celbridge electoral area.

Resolved: That this item remain on the agenda for the September meeting.

To receive briefing on Register of Electors fieldwork 2011/12

Ms Aspell reported to the members that field workers were currently dropping forms to households for inclusion onto the draft register of electors; she also reported that the council had placed a reminder on the council website reminding people to check that they are included on the register and if not how they can be placed on it. Councillor Murphy asked that all deceased people be removed form the register. Ms Aspell reported that the HSE now provide the council with a list of people who have died within the county on a quarterly basis

Cemetery facilities at Donaghcomper, Celbridge

It was reported that lands had been secured by the council to extend Donaghcomper Cemetery; the members were pleased with the outcome. Councillor Murphy asked how long it would be before it would be operational. The members also queried if the council would be working with church authorities in relation this item.

Resolved: That the environmental department prepare a further report in relation to the members queries.

Toni River Flood Alleviation Scheme.

The committee considered the following motion in the name of Councillor Byrne:

To ask Kildare County Council to provide a progress report on the Toni River Flood Alleviation Scheme.

The construction phase of the Toni River Flood Alleviation Scheme  commenced in late 2009 and has been recently completed, with Clonmel Enterprises  Limited being the contractor appointed to undertake the works based on the preliminary design as prepared by the Council's Consulting Engineer. The works involved could be broken into two sections, north of the Celbridge Relief Road and south of the Celbridge Relief Road. The works completed to the north of the relief road amounted to the diversion of all flood flows from the upper end of the Toni River catchment to the existing pipeline through St Raphael’s Manor and into the River Liffey upstream of Celbridge town centre. This work would ensure that the risk of flood flows from the Oldtown Road crossing onto Church Road and into Celbridge town centre would be significantly reduced.

On the southern side of the relief road, works were concentrated in Vanessa Close, Celbridge Town AFC, Dara Court, Convent / Haven Hire and between Celbridge Main Street and the River Liffey.  The works completed were as follows:

 

Vanessa Close

The works in Vanessa Close consisted of the deepening and re-grading of the river channel to increase the conveyancing capacity of the river.  The existing foot bridge was also replaced to reflect the requirement for additional capacity.

 

Celbridge Town AFC:

An additional culvert was laid through the grounds of Celbridge Town AFC, in order to augment the existing culvert capacity on the Toni River in this location. The provision of this additional culvert, together with associated head walls and trash screens would significantly reduce the risk of flooding in this and the Vanessa Lawns area.

 

Dara Court:

The existing Toni River Channel was re-aligned and re-graded to accommodate the required volume of flow.  The work in this area also included the increase of  embankment height along the channel, landscaping (reinstatement of grassed area, planting of thorn bushes etc.) and the provision of trash screens.  It was noted that during the works the local residents made very strong representations to pipe this section of the Toni River - due to hydraulic reasons however, which include the capacity available in the pipeline downstream of the open channel section, this was not possible.

 

Convent / Haven Hire:

The existing open channel sections running through both the Convent and Haven Hire sites were upgraded to allow for the required increase in conveyance capacity.  All crossings of the river in Haven Hire were also upgraded.

 

Main Street to River Liffey:

Again, this section of the channel was upgraded.  This upgrade included the removal of trees and other site clearance to allow for this upgrade.

 

General Works:

Other works undertaken included jetting of all culvert sections on the Toni River system in Celbridge to provide the optimum capacity available in the system.

In summary, it was noted that the completion of this scheme would significantly reduce the risk of flooding along the Toni River.  It was also noted however that all works undertaken were done so in a developed, urban environment and that the works undertaken were deemed to be the best options available for maximizing the capacity of the current drainage situation along the Toni River channel.

River Liffey at Castledillon in Straffan

The committee considered the following motion in the name of Councillor Murphy:

What are the council’s plans for the River Liffey at Castledillon in Straffan?

At the moment, Kildare County Council has no immediate plans for any works on the River Liffey, apart from the advancement of the Liffey CFRAMS project (Catchment Flood Risk Assessment and Management Study), which would define requirements for flood management within the entirety of the Liffey catchment.

In general terms, the cleaning of major drainage channels, such as the River Liffey, required serious consideration to be given to environmental constraints associated with such work, such as the requirements of the Eastern Regional Fisheries Board and the Parks and Wildlife Service.  The level of constraint in place due to the requirements of these, and other, agencies was such that cleaning water courses, by dredging, was no longer possible and the Liffey CFRAMS project would take this into account when formulating recommendations for the Liffey. This aside however, the water services section had agreed to meet the relevant landowner on site and to discuss the above with this landowner.

Councillor Murphy asked if the larger broken trees and debris could be removed from the river.

Resolved: That the water services section investigates the possibility of removing the larger broken trees and debris from the river Liffey

Street tree pruning in Celbridge

The committee considered the following motion in the name of Councillor Byrne:

To ask the parks department of Kildare County Council to prune trees at the following locations;

·      opposite house number 40, Vanessa Lawns, Celbridge

The parks department reported that these locations would be assessed to see what extent of work was required. The scheduling of any necessary work in the arboricultural works programme would have to be considered in relation to the requests already received and the finance available to carry out the work.

Allocation of Sports Grants in 2010

The committee considered the following motion in the name of Councillor Griffin:

What is the current position of the sports grant which in the past was made available to a variety of sports groupings within the county?

The Leisure services department reported that there were no allocations of sport grants in 2010.in 2009; grants were paid out to various clubs and groups from the previous two years. It was hoped that there would be finance available in 2011 to service next years grants.

Councillor Griffin reported that he had hoped that this grant would be reinstated in 2011 as lots of clubs and societies were in need of it, he also asked if money had been allocated for 2010 but used in 2009, if so where had it been used. It was agreed by all that this grant should be included in the Budget for 2011.

Resolved: That Sports Grants for 2011 be included in Budget 2011.

Re-design green area in Loughnamona, Leixlip

The committee considered the following motion in the name of Councillor Griffin:

In order to make it environmentally friendly is it possible for the parks department to redesign the green area at the first cul-de-sac in Loughnamona, Leixlip?

The parks department reported that they would consider Councillor Griffins request if he could provide further details as to what design requirements were needed. In addition the scheduling of the work would have to be considered in the context of the existing work commitments for the current year and also the financial resources available.
