Minutes of Meeting

held at 10.00 a.m. on Friday, 19 November  2010

in the Council Chamber, Áras Chill Dara.

CE 01/11/10

Minutes and Progress Report

The committee considered the minutes of the monthly meeting held on 19 October 2010. Resolved on the proposal of Councillor McGinley and seconded by Councillor Byrne that the minutes be confirmed and taken as read.

 

 

Dublin Bus

The roads department reported that they had written to the NTA, Dublin Bus and the Department of Transport on this issue at the end of July 2010.  The NTA stated that the queries raised could be best covered by written correspondence and undertook to respond in advance of the meeting.  Unfortunately, no further response was received.  A reminder was sent to the NTA in this regard. Councilor McGinley stated that the required infrastructure had not been installed yet and also that the changes to the 66x route were to be implemented from Monday, 22 of November, he also asked that Derry O’Leary be contacted as soon as possible for an update.

 

 

Repair of Speed cushions, Crodaun Forest Park

The members asked that the roads department seek legal advice regarding the quality and longevity of the materials used in certain speed cushions and whether the council should be reimbursed by the contractor. It was also suggested that the contractor should be told to either repair/replace the speed cushions or the council would look elsewhere for the provision of speed cushions.

 

 

 

Flood Relief Schemes

Councillor Murphy asked: To date, flood alleviation works completed in the Leixlip/Celbridge and Straffan areas were as follows:

1. Rye Water and Silleachain Flood Alleviation Schemes (2009) - Leixlip;

2. Toni River Flood Alleviation Scheme (2009/2010) - Celbridge;

3. Morrell River cleaning (2010) - Straffan.

Councillor Murphy asked that the water services department clarify the exact location regarding the removed soakpit i.e. Captains Hill and if so how was it removed?

Water Services at the meeting reported that they had referred the issue of the soak pit to the Area Engineer.  Unfortunately, the Area Engineer has no knowledge of a soak pit being removed. Councillor Murphy stated that the members had received a report regarding this issue in 2006 from the water services department recommending that that the soakpit be removed and be replaced by piping; she asked that they reinvestigate this matter.

 

 

 

Restoration work in Maynooth and Celbridge/ Overflow of Storm drains, English Row, Celbridge

The area engineer would consider the Councillor Byrnes request regarding raising the footpath. Councillor Byrne asked for a costing for the design and installation of a footpath be presented to the members at the December meeting.

 

 

 

 

Flood Defence wall, Celbridge

It was reported that The Office of Public Works was currently working on producing the Liffey Catchment Flood Risk Assessment and Management Study (CFRAMS) project. This study would detail the proposed capital works and possible management systems for flood waters in the River Liffey system.

The water services section reported that no funding was available to undertake the construction of flood defences along the River Liffey and the construction of such defences along the main river would be deemed premature pending the completion of the CFRAMS report. The members asked that this item would remain on the action plan and asked when the CFRAMS report would be ready.

 

 

 

Unauthorised developments in Celbridge

The planning department reported that it was the policy of the Planning Authority to protect the confidentiality of the complainants and it was for this reason that the files were not accessible to the public or the members.   Unauthorised developments could be identified on the relevant maps through the council’s on-line web service once a warning letter and/or enforcement notice had been served.   The database system provides detailed information on all UD cases and could be searched by name, address and UD number.  There were too many UD cases in the Celbridge electoral area to provide information on all of them to the members.  However if a Councillor had a query on a particular UD case, they could provide them with an update on that case. The committee asked that a member of staff from the planning department attends the December meeting to discuss this issue and the problem with lack of prosecution or action on those who found to be in breech of the unauthorised development laws.

 

 

Process with receiver at Meadowbrook Estate

The member requested that this item remain on the action plan until the process with the developer was complete and an update available.

 

 

Alcohol Bye-Laws

It was reported that an early meeting with the gardaí would be arranged to discuss enforcement issues. It agreed that the committee would discuss this issue again at the January meeting.

 

 

Laurel Lodge

Councillor Murphy was unhappy that this item had not been placed on the agenda as requested at the October meeting, it was explained to Councillor Murphy that the reason for it being omitted from the agenda was that the departments in question did not have a further update and that once an update was available it would be presented to the members. Councillor Murphy then asked that this item be discussed at the December meeting in an open session, the meetings administrator reported that this item could be discussed in open session if all members were happy to do so; it was agreed by all to place this item on the agenda for the December meeting in an open session.

Celbridge Traffic Management Plan

To receive an update on the Celbridge Traffic Management Plan

Ms Kavanagh reported that a preliminary meeting had been held with the National Transport Authority to discuss a list of potential sustainable transport schemes to be funded in 2011.  In addition, the draft NTA Strategy was due to be published for public consultation at the end of the year. The Celbridge Traffic Management plan was one of the schemes proposed for funding in 2011. Councillor Byrne stated that some of the required works would be inexpensive and could possibly be done outside of the CTMP, Councillor Murphy agreed with Councillor Byrne and she requested that 30 minutes be set aside for the meeting to look at the plan in a detailed manner with a view to separating certain works to see if they could be funded under different schemes, i.e. discretionary funds etc. Ms Kavanagh reported that it would be January or February before the council would be informed of the allocation of funding for 2011. It was agreed that this item would be discussed at the January meeting.

Resolved: That this item be discussed again in January 2011.

Leixlip Pay Parking

To discuss enforcement of Leixlip Parking Bye-Laws.

The roads department reported that it was hoped that the draft parking bye-laws for Leixlip would be presented to the Celbridge area committee at the December meeting.  The 1 or 2 hour parking had been resolved. Signs had been erected on all approach roads to the town and in the Health Centre car park. The roads department had recently met with a representative of Dun Carraig Residents Association regarding parking in the estate to resolve the parking issues there and that these issues would be addressed in the Draft Parking Bye-Laws. Councillor Kelly reported that the new sings were inadequate as they were not clear and were hard to read when driving, they should be placed in better locations were people could actually stop on foot and read them. The members reported that people had received fines for parking in areas were the new bye-laws were not actually in place yet and that the council should be waiving all these particular fines. Ms Kavanagh reported that anybody who did receive parking fines during the affected time period in the Main Street, Carpark, Leixlip should contact the council to have the fine reinvestigated and waived ( if applicable) she also reported that the new bye-laws when enforced would alleviate and eliminate any current problems.

Resolved: That the parking bye-laws be discussed at the December area meeting.

Naming of new road between Straffan Road and Meadowbrook Road

The following motion was considered in the name of Councillor McGinley:

That a name be given to the new road between Straffan Road and Meadowbrook Road and that appropriate sign posts be erected.

The roads department reported that they would commence the statutory process if the members wished to do so. Councillor McGinley suggested that the road be called “ Sundrive road” , Meadowbrook link road was also suggested as this is the name currently being used by locals. An Cathaoirleach reported that roads were generally named after the original townsland and that this area had been known as Dowdstown. Councillor Murphy stated that other new roads had been named after the areas they were in. Ms Kavanagh welcomed all suggestions from the members.

Resolved: That the statuary process begin to name the new road between Straffan Road and Meadowbrook Road

Parking Regulations, Parsons Street, Maynooth

The following motion was considered in the name of Councillor McGinley:

That the Garda at senior level be asked to ensure that parking regulations are adhered to in Parsons Street, Maynooth in order to put an end to cars and four wheeled vehicles parking on the footpath and in order to permit vehicles to drive in two lanes. The roads department reported that they would write to the Chief Superintendent on behalf of the committee.

Councillor McGinley asked that this item remain on the agenda for the December meeting.

Resolved: That this item be placed on the agenda for the December area meeting.

Review of the parking by-laws, Celbridge

The following motion was considered in the name of Councillor Byrne:

That the council now put in place a review of the parking by-laws for Celbridge to deal with a number of issues that have arisen since the by-laws were last reviewed.

The roads department reported that there was a significant cost associated with reviewing the bye laws. Having regard to the fact that the bye laws were reviewed in 2008 and 2009 it was not felt that a further review was necessary at this time.  Councillor Byrne totally disagreed with the report as he had received many complaints regarding the current parking arrangements. Councillors Murphy and Kelly asked if elements of the current bye-laws could be tweaked of amended. Ms Kavanagh stated that this was not possible as legislation in place does not allow for that, she suggested that Councillor Byrne forwards the complaints he had received to her and that they would see what could be done. It was also suggested that this item be forwarded to the transportation SPC to discuss the possibility of changing the legislation to allow small amendments and reviews take place for parking bye-laws.

Resolved: That the issue of changing the legislation regarding parking bye-laws be discussed at the next transportation SPC meeting.

Storm drains in Vanessa Close and Ballymakealy Estates

The following motion was considered in the name of Councillor Byrne:

That the storm drains in Vanessa Close and Ballymakealy housing estates, Celbridge be cleaned to prevent flooding of the roadways in these estates.

The roads department reported that the road gullies in estates were cleaned on a rota basis when resources were available. Vanessa Close was cleaned at the end of September and it was planned to work through other estates as manpower was available. An Cathaoirleach thanked Eilis and the staff in the area office for their hard work and stressed that it was important that gullies were kept as clear as possible at this time of the year. Councillor Murphy asked how many staff were employed in the area offices and Councillor Purcell for a copy of the gully cleaning schedule for the year.

Pedestrian Crossing, Clane Road, Celbridge

The following motion was considered in the name of Councillor Byrne:

That the council examine how a safe pedestrian crossing can be provided at the junction of Saint Raphaels Manor, Abbey Farm and the Clane Road, Celbridge with particular emphasis on school children who cross there.

The transportation department reported that there was has no funding for undertaking traffic/pedestrian studies or the implementation of such studies in the county unless it was from an external funding source. Issues relating to excessive speeding and road safety could be referred to the Garda Siochana for enforcement should specific information be available at the above location from local councillors. Perhaps pedestrian traffic should be encouraged to use the existing, recently upgraded, pedestrian crossing outside St. John of Gods.

Councillor Murphy asked that a traffic count be done at Abbey Farm/ St Raphaels Manor on the Clane Road, Celbridge.

Painting of Cycle lanes, Celbridge electoral area

The following motion was considered in the name of Councillor Murphy

We ask for a report from the area engineer about her approach to painting and repainting cycle lanes and tracks in the Celbridge Electoral Area, we also consider recommending a policy for inclusion in the County Development Plan, whereby cycle lane markings close to busy urban schools receive a higher priority than the markings on rural roads.

The roads department reported that the council was awaiting the publication of the National Cycle Manual by the National Transport Authority in 2010.  This document would make reference to the maintenance of cycletracks and best practice for this and other issues.  Highlighting cycle facilities at conflict points would be considered a reasonable initiative, however, prioritising markings solely based on the type of road was not recommended.  Furthermore, the availability, or lack of funding, must be considered.

Traffic problems on Straffan Road, Maynooth

The following motion was considered in the name of Councillor Murphy:

In view of the traffic problems on Straffan Road, Maynooth particularly at the morning peak that the council considers the role played by the traffic lights at the junction with Main Street, Main Street and Mill Street and Main Street and Kilcock Road, we consider what changes can be made specific to morning peak times, if turning off some of the lights for these times would contribute towards a solution and if so how pedestrians can be safely accommodated.

As reported previously, the traffic signalling arrangement in Maynooth Town is managed by a state of the art Urban Traffic Control System (SCOOT) and this provides optimum signal timings for the motorised demands at all junctions. This type of control is used in all of Ireland’s main cities and Kildare is the first non-metropolitan   county to install and maintain such a sophisticated system. Towns in Kildare currently using the system are Newbridge, Naas and Maynooth. The computerised UTC system balances the demands at all junctions linked within Maynooth Town and this is demonstrated by the passage of vehicles from the Straffan Road/Main Street Junction to the Kilcock Road/Moyglare Road Junction (in both directions).  Delays to traffic on the approaches to these junctions are not as a result of the signalling arrangement but due to the high levels of motorised traffic wanting to use the junctions.  Co-ordination between the signals allow for pedestrian crossing timings to be run together to minimise the delay to traffic and maximise the amount of time allocated to crossing pedestrians.

The suggestion to turn off some or all of the lights would be counter-productive and would result in creating traffic hazards for both vulnerable road users and motorists.  When signals are off, there is no safe facility for turning traffic or for crossing pedestrians. Councillor Murphy reported that there were major problems at peak times and that the traffic seemed to flow better when the lights were turned off she also suggested that the council should be pro-active instead of re-active, An Cathaoirleach agreed with Councillor Murphy and reported that Mill Street was a major problem and that lives would be lost if this problem was not rectified as soon as possible.

Road markings, Ryevale Tavern, Leixlip

The following motion was considered in the name of Councillor Purcell:

That the council examine moving the single white line on the road outside Ryevale Tavern, Leixlip to a point closer to the Tavern to allow other traffic to pass whilst a stationary vehicle is turning right into Tavern car park.  Further that a yellow box be installed at his point to allow traffic exit from the Tavern.

The roads department reported that roads design would carry out a preliminary survey to determine what best solution, if any, could be considered for this location. However, any works would be dependent on funding being identified.

Sand/salt sandbags

The following motion was considered in the name of Councillor Purcell:

That the council indicate the stocks of sand/salt sandbags etc that are being held in reserve at the Maynooth area office for inclement weather.

The Maynooth area office reported that they had approximately 1500 sandbags in stock and approximately 40 tonnes of salt. Councillor Purcell also requested that the Civil Defence also cover the North Kildare area as at present they do not cover that part of the county.

Resolved: that the Civil Defence be deployed to the North of County during emergencies.

Banning of HGV traffic in Straffan

The following motion was considered in the name of Councillor McGinley:

What progress has been made on banning through traffic HGVs from Straffan?

It was reported that informal discussions had been held with the Gardai and an official submission had been sought regarding this proposal.  Early indications are that the Gardai would not be in favour of banning through HGV traffic through Straffan. Councilor McGinley was astounded that the Gardaí were opposed to banning the HGV’s , Ms Kavanagh stated the Gardaí were concerned about the alternative routes for the HGV’s if they were to be banned form the village, Councillor McGinley asked that this item remain on the agenda for a further report for the December meeting.

Missing public lights, Old Greenfield, Maynooth

The following motion was considered in the name of Councillor McGinley:

When are the missing public lights at the rear of houses (details supplied) at Old       Greenfield, Maynooth going to be re-installed?

It was reported that this issue had been reported to the council’s current public lighting maintenance contractor (Airtricity) and was on the list of repairs to be completed before the end of 2010. Councillor McGinley reported that the lights were removed by a contractor doing works at this location and that the council should pursue them to re-install the lights at their own expense.

Resolved: that the council pursue the contractor that removed the lights and request them to re-install the lights at their own expense.

Provision of Traffic signals Straffan Road/Meadowbrook Link Road junction?

The following motion was considered in the name of Councillor McGinley:

What progress has been made on the provision of traffic signals at the Straffan Road/Meadowbrook Link Road junction?

As previously advised, a number of planning permissions in the area have      been conditioned to provide / contribute towards traffic signals at the above location. To date no progress has been made by the private sector in this regard.  Unfortunately, Kildare County Council does not have any funding to carry out this type of work unless it is funded from an external source. Councillor McGinley stated that a roundabout would be ideal at this location and suggested that the council approach the developer and ask that they provide it.

Resolved: That the roads department make contact with the developer and ask that he provide a roundabout at this location.

Flooding outside residence on Dublin Road, Celbridge

The following motion was considered in the name of Councillor McGinley:

To ask the area engineer to examine the flooding that occurs outside (details supplied) on the Dublin Road, Celbridge and that has arisen recently.

The roads department reported that some flooding occurs outside the Graveyard on the Dublin Road which appears to have been caused by Bord Gais damaging a surface water pipe.  This issue has been referred to Bord Gais for attention. It was reported at the meeting that this problem had been rectified.

Right hand turn, Church Road/ St Patricks Park, Celbridge

The following motion was considered in the name of Councillor Byrne:

To ask the council to examine the possibility of providing a right hand turn on Church Road (Tea Lane) where it meets the entrance to Saint Patricks Park, Celbridge as a matter of urgency.

The roads department reported that the roads design section would carry out a preliminary survey to determine if a right turning lane would be possible, and safe, at this location.

Resolved: That the roads design section return to the January meeting with a report on the suitability of providing a right hand turn at this location.

Repainting of Yellow box for exit at Castlevillage estate, Celbridge

The following motion was considered in the name of Councillor Byrne:

To ask the area engineer if she will arrange to have the yellow box at the exit from Castlevillage estate, Celbridge re-painted as the existing markings have faded or worn to the point where they are no longer visible.

The area office reported that there was no funding for re-instating this yellow box at present.  If funding was made available in 2011 the lining could be carried out. Councillor Byrne requested a costing for the requested yellow box.

Resolved: That costing for the repainting of the yellow box at exit from Castlevillage estate, Celbridge be prepared for the December meeting.

Bonfire damaged footpath, Willowbrook

The following motion was considered in the name of Councillor Murphy:

When will the pathway damaged by a bonfire last year at Willowbrook be repaired, when will the glass strewn here be removed and when will the items removed from the playground be replaced?

Repair of the footpath will undertaken in conjunction with other path repairs before the end of the year. The paths would be cleaned in the next two weeks. Replacement parts for the equipment removed in the playground were ordered and it was hoped to have these installed in the next month.

Pedestrian/traffic count Green Lane / Castletown/ Oaklawn at school times

The following motion was considered in the name of Councillor Murphy:

Has a pedestrian/traffic count taken place at the junctions of Green Lane / Castletown / Oaklawn at school times, if so what were the results, if not can one be done?

The roads department reported that the roads design section would carry out the required counts before the December meeting. Councillor Murphy asked that the results of the count be presented to the committee at the December meeting.

Resolved: That the results of the Pedestrian/traffic count Green Lane / Castletown/ Oaklawn at school times be prepared for the December area meeting.

 

 

CE21/11/10

Traffic restrictions for back lane, Main Street, Cebridge

The following motion was considered in the name of Councillor Murphy:         

Can we have an outline of all the options that have been considered for restricting traffic in the back lane behind Main Street, Celbridge and St Patrick’s Park, what had been done already and what options remain?

The roads department reported that there were height restrictions in place.  However, further restrictions would restrict all traffic, including residents wishing to access the rear of their homes.  Unfortunately, it would not appear that there were any other feasible options available at this time. Councillor Murphy reported that the residents were unhappy with the current resolution and asked what other options were available to the council. Ms Kavanagh replied that no other options were suitable for the location.

Leixlip Pay parking regulations

The following motion was considered in the name of Councillor Purcell:          

To ask the council if a date has been set to finalise regulated parking in Leixlip and if the matter of 1 or 2 hour parking has been resolved in Main Street car park and Dun Carraig.

Design of entrance, Riverdale estate, Leixlip

The following motion was considered in the name of Councillor Purcell:

To ask the council what progress has been made in the design of the entrance to Riverdale estate in conjunction with Leixlip Town Council.

It was reported that Leixlip Town Council’s proposals were sent to the planning department for consideration.  A response is awaited. Councillor Purcell asked that this item be progressed as soon as possible as the works required were minimal.

Resolved: That the members be kept informed of any progress on this matter.

Derelict Sires, Maynooth

The following motion was considered in the name of Councillor McGinley:

That immediate action be taken against the owner of derelict row of houses in Maynooth (details supplied) under the derelict sites act.

Mr Liam Dunne of the environmental department reported to the members that the owner of one of the properties have been directed to complete the required works within the next four weeks and that a Section 11 note was to be served on the other property owner. Councillor McGinley was unhappy about the plan to board up the windows as he felt that it boarded windows would lower the appearance of the properties, he suggested that the owner should be required to replace the windows. Mr Dunne reported that the aim of boarding up the windows was to ensure that the building was safe and secure; he also stated that they would require the appearance of the building to be satisfactory.

Sewerage odour, Rye Bridge, Leixlip

The following motion was considered in the name of Councillor Purcell:

That this committee gets an up to date review of the reasons for the sewerage smell at Rye Bridge, Leixlip.

The water services department reported that the odours reported in the vicinity of the Ryevale Tavern Hotel arose from the recently constructed storm overflow connection to the storm culvert. In addition this storm culvert was blocked with debris and stagnant waters. The odour has not been            reported beyond the entrance of the Ryevale Tavern Hotel.

To remove the problem it was intended:-

  • To either incorporate a water seal into the overflow or to pipe the overflow directly to the Rye River in order to prevent any odours escaping.
  • To undertake works in the storm culvert to prevent the build up of debris and stagnant waters.
  • To ensure that an adequate rate of dosing was maintained to minimise odour generation.
    • To ensure that the vortex units were properly maintained and
  • To ensure that all manholes in the vicinity of Oldhill / Pound Street were kept seale

Mr Bargoutti reported that at present the only solution to eliminate the problem was to try and extend the emergency overflow during heavy wet conditions and that all the manholes in Pound Street be covered, this would only be a temporary measure to protect residents properties during bad weather conditions. Councillor Purcell was unhappy at the prospect of raw sewage being disposed of in the River Rye and asked that a better solution be sought he also declared that the original works undertaken were supposed alleviate the odour and the sewage problems and it now seemed that we had taken a backward step and there was no adequate solution in sight, ha also requested that a sample of the water be tested.

Resolved: That the water services section test the quality of the water and report back to the members.

Shop signage in Leixlip

The following motion was considered in the name of Councillor Purcell:

That the committee receive an update from the planning section concerning the proposed visit to Leixlip to check on signage etc as reported at the last area meeting.

The planning department reported that as promised visited Leixlip to examine the  signage situation. Signage considered to be inappropriate was photographed and an unauthorised development file opened for each separate site. The planning department was now examining the planning history for the sites to ascertain if the subject signage had the benefit of planning permission. The planning department also needed to identify the owners of a number of the properties concerned. The investigations were ongoing and the planning department would take the necessary enforcement action in due course. Leixlip Youth and Community Centre, Newtown House

The following motion was considered in the name of Councillor McGinley:

That the issues with the Leixlip Youth and Community Centre, Newtown House (roofing, lighting/electricity supply, sewage, etc) be addressed without any further delay.

Mr Perry reported that the housing department were in the process of seeking legal on some of the issues and that a list of works to be carried out was being compiled; he also reported that there was a problem with securing funding for the necessary works to be completed. Councillor Murphy reported that the problem with the building was getting        worse by doing nothing and that the roof in particular needed urgent attention, she suggested that Leixlip Town Council maybe in a position to help fund the works.

Resolved: That the housing department contact the town council to see if they could assist in funding the repairs to Leixlip Youth and Community Centre.

Standing Orders and Closed Sessions

The following motion was considered in the name of Councillor Murphy:

That the public and press are admitted to all Celbridge Area Committee meetings, except where a vote is taken to exclude them, in line with section 19 of the standing orders.  In cases where an agenda issues for a closed session, that minutes are taken and           circulated afterwards, in cases where the subject under discussion at area meetings           requires a decision, such a decision is postponed until it can be taken in open session.

      The meetings administrator reported that Standing Orders allow for closed sessions of  committees by agreement of the members "to allow for discussion of  private and confidential matters". While members had discretion in this matter, they may prefer to consider some issues in private. It was not considered that the present use of closed sessions conflicts with standing orders or legislation governing public access to meetings. Councillor Murphy reported that no vote had been taken and that this council were in breach of the legislation in place. The meetings administrator agreed that no vote had taken place, he explained that this could happen when matters arise outside of the usual motions and questions, i.e. other business: which was what had occurred with this particular item. A long discussion ensued regarding closed sessions and it was agreed by all that the members would vote on whether they would discuss “sensitive issues” in a closed or open session. A vote took place regarding “Laurel Lodge” and it was agreed to discuss this item in an open session at the December meeting. The issue regarding the erection of a boundary fence was also raised and Councillor Kelly asked how much this would cost.

Resolved: that “Laurel Lodge” be discussed in an open session at the December meeting.

Minutes and Progress Report

The committee considered the minutes of the monthly meeting held on 19 October 2010. Resolved on the proposal of Councillor McGinley and seconded by Councillor Byrne that the minutes be confirmed and taken as read.

 

 

Dublin Bus

The roads department reported that they had written to the NTA, Dublin Bus and the Department of Transport on this issue at the end of July 2010.  The NTA stated that the queries raised could be best covered by written correspondence and undertook to respond in advance of the meeting.  Unfortunately, no further response was received.  A reminder was sent to the NTA in this regard. Councilor McGinley stated that the required infrastructure had not been installed yet and also that the changes to the 66x route were to be implemented from Monday, 22 of November, he also asked that Derry O’Leary be contacted as soon as possible for an update.

 

 

Repair of Speed cushions, Crodaun Forest Park

The members asked that the roads department seek legal advice regarding the quality and longevity of the materials used in certain speed cushions and whether the council should be reimbursed by the contractor. It was also suggested that the contractor should be told to either repair/replace the speed cushions or the council would look elsewhere for the provision of speed cushions.

 

 

 

Flood Relief Schemes

Councillor Murphy asked: To date, flood alleviation works completed in the Leixlip/Celbridge and Straffan areas were as follows:

1. Rye Water and Silleachain Flood Alleviation Schemes (2009) - Leixlip;

2. Toni River Flood Alleviation Scheme (2009/2010) - Celbridge;

3. Morrell River cleaning (2010) - Straffan.

Councillor Murphy asked that the water services department clarify the exact location regarding the removed soakpit i.e. Captains Hill and if so how was it removed?

Water Services at the meeting reported that they had referred the issue of the soak pit to the Area Engineer.  Unfortunately, the Area Engineer has no knowledge of a soak pit being removed. Councillor Murphy stated that the members had received a report regarding this issue in 2006 from the water services department recommending that that the soakpit be removed and be replaced by piping; she asked that they reinvestigate this matter.

 

 

 

Restoration work in Maynooth and Celbridge/ Overflow of Storm drains, English Row, Celbridge

The area engineer would consider the Councillor Byrnes request regarding raising the footpath. Councillor Byrne asked for a costing for the design and installation of a footpath be presented to the members at the December meeting.

 

 

 

 

 

Flood Defence wall, Celbridge

It was reported that The Office of Public Works was currently working on producing the Liffey Catchment Flood Risk Assessment and Management Study (CFRAMS) project. This study would detail the proposed capital works and possible management systems for flood waters in the River Liffey system.

The water services section reported that no funding was available to undertake the construction of flood defences along the River Liffey and the construction of such defences along the main river would be deemed premature pending the completion of the CFRAMS report. The members asked that this item would remain on the action plan and asked when the CFRAMS report would be ready.

 

 

 

Unauthorised developments in Celbridge

The planning department reported that it was the policy of the Planning Authority to protect the confidentiality of the complainants and it was for this reason that the files were not accessible to the public or the members.   Unauthorised developments could be identified on the relevant maps through the council’s on-line web service once a warning letter and/or enforcement notice had been served.   The database system provides detailed information on all UD cases and could be searched by name, address and UD number.  There were too many UD cases in the Celbridge electoral area to provide information on all of them to the members.  However if a Councillor had a query on a particular UD case, they could provide them with an update on that case. The committee asked that a member of staff from the planning department attends the December meeting to discuss this issue and the problem with lack of prosecution or action on those who found to be in breech of the unauthorised development laws.

The member requested that this item remain on the action plan until the process with the developer was complete and an update available.

 

 

 

 

Alcohol Bye-Laws

It was reported that an early meeting with the gardaí would be arranged to discuss enforcement issues. It agreed that the committee would discuss this issue again at the January meeting.

 

 

Laurel Lodge

Councillor Murphy was unhappy that this item had not been placed on the agenda as requested at the October meeting, it was explained to Councillor Murphy that the reason for it being omitted from the agenda was that the departments in question did not have a further update and that once an update was available it would be presented to the members. Councillor Murphy then asked that this item be discussed at the December meeting in an open session, the meetings administrator reported that this item could be discussed in open session if all members were happy to do so; it was agreed by all to place this item on the agenda for the December meeting in an open session.

Celbridge Traffic Management Plan

To receive an update on the Celbridge Traffic Management Plan

Ms Kavanagh reported that a preliminary meeting had been held with the National Transport Authority to discuss a list of potential sustainable transport schemes to be funded in 2011.  In addition, the draft NTA Strategy was due to be published for public consultation at the end of the year. The Celbridge Traffic Management plan was one of the schemes proposed for funding in 2011. Councillor Byrne stated that some of the required works would be inexpensive and could possibly be done outside of the CTMP, Councillor Murphy agreed with Councillor Byrne and she requested that 30 minutes be set aside for the meeting to look at the plan in a detailed manner with a view to separating certain works to see if they could be funded under different schemes, i.e. discretionary funds etc. Ms Kavanagh reported that it would be January or February before the council would be informed of the allocation of funding for 2011. It was agreed that this item would be discussed at the January meeting.

Leixlip Pay Parking

To discuss enforcement of Leixlip Parking Bye-Laws.

The roads department reported that it was hoped that the draft parking bye-laws for Leixlip would be presented to the Celbridge area committee at the December meeting.  The 1 or 2 hour parking had been resolved. Signs had been erected on all approach roads to the town and in the Health Centre car park. The roads department had recently met with a representative of Dun Carraig Residents Association regarding parking in the estate to resolve the parking issues there and that these issues would be addressed in the Draft Parking Bye-Laws. Councillor Kelly reported that the new sings were inadequate as they were not clear and were hard to read when driving, they should be placed in better locations were people could actually stop on foot and read them. The members reported that people had received fines for parking in areas were the new bye-laws were not actually in place yet and that the council should be waiving all these particular fines. Ms Kavanagh reported that anybody who did receive parking fines during the affected time period in the Main Street, Carpark, Leixlip should contact the council to have the fine reinvestigated and waived ( if applicable) she also reported that the new bye-laws when enforced would alleviate and eliminate any current problems.

Resolved: That the parking bye-laws be discussed at the December area meeting.

Naming of new road between Straffan Road and Meadowbrook Road

The following motion was considered in the name of Councillor McGinley:

That a name be given to the new road between Straffan Road and Meadowbrook Road and that appropriate sign posts be erected.

The roads department reported that they would commence the statutory process if the members wished to do so. Councillor McGinley suggested that the road be called “ Sundrive road” , Meadowbrook link road was also suggested as this is the name currently being used by locals. An Cathaoirleach reported that roads were generally named after the original townsland and that this area had been known as Dowdstown. Councillor Murphy stated that other new roads had been named after the areas they were in. Ms Kavanagh welcomed all suggestions from the members.

Parking Regulations, Parsons Street, Maynooth

The following motion was considered in the name of Councillor McGinley:

That the Garda at senior level be asked to ensure that parking regulations are adhered to in Parsons Street, Maynooth in order to put an end to cars and four wheeled vehicles parking on the footpath and in order to permit vehicles to drive in two lanes. The roads department reported that they would write to the Chief Superintendent on behalf of the committee.

Councillor McGinley asked that this item remain on the agenda for the December meeting.

Review of the parking by-laws, Celbridge

The following motion was considered in the name of Councillor Byrne:

That the council now put in place a review of the parking by-laws for Celbridge to deal with a number of issues that have arisen since the by-laws were last reviewed.

The roads department reported that there was a significant cost associated with reviewing the bye laws. Having regard to the fact that the bye laws were reviewed in 2008 and 2009 it was not felt that a further review was necessary at this time.  Councillor Byrne totally disagreed with the report as he had received many complaints regarding the current parking arrangements. Councillors Murphy and Kelly asked if elements of the current bye-laws could be tweaked of amended. Ms Kavanagh stated that this was not possible as legislation in place does not allow for that, she suggested that Councillor Byrne forwards the complaints he had received to her and that they would see what could be done. It was also suggested that this item be forwarded to the transportation SPC to discuss the possibility of changing the legislation to allow small amendments and reviews take place for parking bye-laws.

Resolved: That the issue of changing the legislation regarding parking bye-laws be discussed at the next transportation SPC meeting.

Storm drains in Vanessa Close and Ballymakealy Estates

The following motion was considered in the name of Councillor Byrne:

That the storm drains in Vanessa Close and Ballymakealy housing estates, Celbridge be cleaned to prevent flooding of the roadways in these estates.

The roads department reported that the road gullies in estates were cleaned on a rota basis when resources were available. Vanessa Close was cleaned at the end of September and it was planned to work through other estates as manpower was available. An Cathaoirleach thanked Eilis and the staff in the area office for their hard work and stressed that it was important that gullies were kept as clear as possible at this time of the year. Councillor Murphy asked how many staff were employed in the area offices and Councillor Purcell for a copy of the gully cleaning schedule for the year.

Pedestrian Crossing, Clane Road, Celbridge

The following motion was considered in the name of Councillor Byrne:

That the council examine how a safe pedestrian crossing can be provided at the junction of Saint Raphaels Manor, Abbey Farm and the Clane Road, Celbridge with particular emphasis on school children who cross there.

The transportation department reported that there was has no funding for undertaking traffic/pedestrian studies or the implementation of such studies in the county unless it was from an external funding source. Issues relating to excessive speeding and road safety could be referred to the Garda Siochana for enforcement should specific information be available at the above location from local councillors. Perhaps pedestrian traffic should be encouraged to use the existing, recently upgraded, pedestrian crossing outside St. John of Gods.

Councillor Murphy asked that a traffic count be done at Abbey Farm/ St Raphaels Manor on the Clane Road, Celbridge.

Painting of Cycle lanes, Celbridge electoral area

The following motion was considered in the name of Councillor Murphy

We ask for a report from the area engineer about her approach to painting and repainting cycle lanes and tracks in the Celbridge Electoral Area, we also consider recommending a policy for inclusion in the County Development Plan, whereby cycle lane markings close to busy urban schools receive a higher priority than the markings on rural roads.

The roads department reported that the council was awaiting the publication of the National Cycle Manual by the National Transport Authority in 2010.  This document would make reference to the maintenance of cycletracks and best practice for this and other issues.  Highlighting cycle facilities at conflict points would be considered a reasonable initiative, however, prioritising markings solely based on the type of road was not recommended.  Furthermore, the availability, or lack of funding, must be considered.

Traffic problems on Straffan Road, Maynooth

The following motion was considered in the name of Councillor Murphy:

In view of the traffic problems on Straffan Road, Maynooth particularly at the morning peak that the council considers the role played by the traffic lights at the junction with Main Street, Main Street and Mill Street and Main Street and Kilcock Road, we consider what changes can be made specific to morning peak times, if turning off some of the lights for these times would contribute towards a solution and if so how pedestrians can be safely accommodated.

As reported previously, the traffic signalling arrangement in Maynooth Town is managed by a state of the art Urban Traffic Control System (SCOOT) and this provides optimum signal timings for the motorised demands at all junctions. This type of control is used in all of Ireland’s main cities and Kildare is the first non-metropolitan   county to install and maintain such a sophisticated system. Towns in Kildare currently using the system are Newbridge, Naas and Maynooth. The computerised UTC system balances the demands at all junctions linked within Maynooth Town and this is demonstrated by the passage of vehicles from the Straffan Road/Main Street Junction to the Kilcock Road/Moyglare Road Junction (in both directions).  Delays to traffic on the approaches to these junctions are not as a result of the signalling arrangement but due to the high levels of motorised traffic wanting to use the junctions.  Co-ordination between the signals allow for pedestrian crossing timings to be run together to minimise the delay to traffic and maximise the amount of time allocated to crossing pedestrians.

The suggestion to turn off some or all of the lights would be counter-productive and would result in creating traffic hazards for both vulnerable road users and motorists.  When signals are off, there is no safe facility for turning traffic or for crossing pedestrians. Councillor Murphy reported that there were major problems at peak times and that the traffic seemed to flow better when the lights were turned off she also suggested that the council should be pro-active instead of re-active, An Cathaoirleach agreed with Councillor Murphy and reported that Mill Street was a major problem and that lives would be lost if this problem was not rectified as soon as possible.

Road markings, Ryevale Tavern, Leixlip

The following motion was considered in the name of Councillor Purcell:

That the council examine moving the single white line on the road outside Ryevale Tavern, Leixlip to a point closer to the Tavern to allow other traffic to pass whilst a stationary vehicle is turning right into Tavern car park.  Further that a yellow box be installed at his point to allow traffic exit from the Tavern.

The roads department reported that roads design would carry out a preliminary survey to determine what best solution, if any, could be considered for this location. However, any works would be dependent on funding being identified.

Sand/salt sandbags

The following motion was considered in the name of Councillor Purcell:

That the council indicate the stocks of sand/salt sandbags etc that are being held in reserve at the Maynooth area office for inclement weather.

The Maynooth area office reported that they had approximately 1500 sandbags in stock and approximately 40 tonnes of salt. Councillor Purcell also requested that the Civil Defence also cover the North Kildare area as at present they do not cover that part of the county.

Resolved: that the Civil Defence be deployed to the North of County during emergencies.

Banning of HGV traffic in Straffan

What progress has been made on banning through traffic HGVs from Straffan?

It was reported that informal discussions had been held with the Gardai and an official submission had been sought regarding this proposal.  Early indications are that the Gardai would not be in favour of banning through HGV traffic through Straffan. Councilor McGinley was astounded that the Gardaí were opposed to banning the HGV’s , Ms Kavanagh stated the Gardaí were concerned about the alternative routes for the HGV’s if they were to be banned form the village, Councillor McGinley asked that this item remain on the agenda for a further report for the December meeting.

Missing public lights, Old Greenfield, Maynooth

The following motion was considered in the name of Councillor McGinley:

When are the missing public lights at the rear of houses (details supplied) at Old       Greenfield, Maynooth going to be re-installed?

It was reported that this issue had been reported to the council’s current public lighting maintenance contractor (Airtricity) and was on the list of repairs to be completed before the end of 2010. Councillor McGinley reported that the lights were removed by a contractor doing works at this location and that the council should pursue them to re-install the lights at their own expense.

Provision of Traffic signals Straffan Road/Meadowbrook Link Road junction?

The following motion was considered in the name of Councillor McGinley:

What progress has been made on the provision of traffic signals at the Straffan Road/Meadowbrook Link Road junction?

As previously advised, a number of planning permissions in the area have      been conditioned to provide / contribute towards traffic signals at the above location. To date no progress has been made by the private sector in this regard.  Unfortunately, Kildare County Council does not have any funding to carry out this type of work unless it is funded from an external source. Councillor McGinley stated that a roundabout would be ideal at this location and suggested that the council approach the developer and ask that they provide it.

Resolved: That the roads department make contact with the developer and ask that he provide a roundabout at this location.

Flooding outside residence on Dublin Road, Celbridge

The following motion was considered in the name of Councillor McGinley:

To ask the area engineer to examine the flooding that occurs outside (details supplied) on the Dublin Road, Celbridge and that has arisen recently.

The roads department reported that some flooding occurs outside the Graveyard on the Dublin Road which appears to have been caused by Bord Gais damaging a surface water pipe.  This issue has been referred to Bord Gais for attention. It was reported at the meeting that this problem had been rectified.

The following motion was considered in the name of Councillor Byrne:

To ask the council to examine the possibility of providing a right hand turn on Church Road (Tea Lane) where it meets the entrance to Saint Patricks Park, Celbridge as a matter of urgency.

The roads department reported that the roads design section would carry out a preliminary survey to determine if a right turning lane would be possible, and safe, at this location.

Resolved: That the roads design section return to the January meeting with a report on the suitability of providing a right hand turn at this location.

Repainting of Yellow box for exit at Castlevillage estate, Celbridge

The following motion was considered in the name of Councillor Byrne:

To ask the area engineer if she will arrange to have the yellow box at the exit from Castlevillage estate, Celbridge re-painted as the existing markings have faded or     worn to the point where they are no longer visible.

The area office reported that there was no funding for re-instating this yellow box at present.  If funding was made available in 2011 the lining could be carried out. Councillor Byrne requested a costing for the requested yellow box.

Bonfire damaged footpath, Willowbrook

The following motion was considered in the name of Councillor Murphy:

When will the pathway damaged by a bonfire last year at Willowbrook be repaired, when will the glass strewn here be removed and when will the items removed from the playground be replaced?

Repair of the footpath will undertaken in conjunction with other path repairs before the end of the year. The paths would be cleaned in the next two weeks. Replacement parts for the equipment removed in the playground were ordered and it was hoped to have these installed in the next month.

Traffic restrictions for back lane, Main Street, Cebridge

The following motion was considered in the name of Councillor Murphy:         

Can we have an outline of all the options that have been considered for restricting traffic in the back lane behind Main Street, Celbridge and St Patrick’s Park, what had been done already and what options remain?

The roads department reported that there were height restrictions in place.  However, further restrictions would restrict all traffic, including residents wishing to access the rear of their homes.  Unfortunately, it would not appear that there were any other feasible options available at this time. Councillor Murphy reported that the residents were unhappy with the current resolution and asked what other options were available to the council. Ms Kavanagh replied that no other options were suitable for the location.

The following motion was considered in the name of Councillor Purcell:

To ask the council what progress has been made in the design of the entrance to Riverdale estate in conjunction with Leixlip Town Council.

It was reported that Leixlip Town Council’s proposals were sent to the planning department for consideration.  A response is awaited. Councillor Purcell asked that this item be progressed as soon as possible as the works required were minimal.

Derelict Sires, Maynooth

The following motion was considered in the name of Councillor McGinley:

That immediate action be taken against the owner of derelict row of houses in Maynooth (details supplied) under the derelict sites act.

Mr Liam Dunne of the environmental department reported to the members that the owner of one of the properties have been directed to complete the required works within the next four weeks and that a Section 11 note was to be served on the other property owner. Councillor McGinley was unhappy about the plan to board up the windows as he felt that it boarded windows would lower the appearance of the properties, he suggested that the owner should be required to replace the windows. Mr Dunne reported that the aim of boarding up the windows was to ensure that the building was safe and secure; he also stated that they would require the appearance of the building to be satisfactory.

Sewerage odour, Rye Bridge, Leixlip

The following motion was considered in the name of Councillor Purcell:

That this committee gets an up to date review of the reasons for the sewerage smell at Rye Bridge, Leixlip.

The water services department reported that the odours reported in the vicinity of the Ryevale Tavern Hotel arose from the recently constructed storm overflow connection to the storm culvert. In addition this storm culvert was blocked with debris and stagnant waters. The odour has not been            reported beyond the entrance of the Ryevale Tavern Hotel.

To remove the problem it was intended:-

  • To either incorporate a water seal into the overflow or to pipe the overflow directly to the Rye River in order to prevent any odours escaping.
  • To undertake works in the storm culvert to prevent the build up of debris and stagnant waters.
  • To ensure that an adequate rate of dosing was maintained to minimise odour generation.
    • To ensure that the vortex units were properly maintained and
  • To ensure that all manholes in the vicinity of Oldhill / Pound Street were kept seale

Mr Bargoutti reported that at present the only solution to eliminate the problem was to try and extend the emergency overflow during heavy wet conditions and that all the manholes in Pound Street be covered, this would only be a temporary measure to protect residents properties during bad weather conditions. Councillor Purcell was unhappy at the prospect of raw sewage being disposed of in the River Rye and asked that a better solution be sought he also declared that the original works undertaken were supposed alleviate the odour and the sewage problems and it now seemed that we had taken a backward step and there was no adequate solution in sight, ha also requested that a sample of the water be tested.

Resolved: That the water services section test the quality of the water and report back to the members.

Shop signage in Leixlip

The following motion was considered in the name of Councillor Purcell:

That the committee receive an update from the planning section concerning the proposed visit to Leixlip to check on signage etc as reported at the last area meeting.

The planning department reported that as promised visited Leixlip to examine the  signage situation. Signage considered to be inappropriate was photographed and an unauthorised development file opened for each separate site. The planning department was now examining the planning history for the sites to ascertain if the subject signage had the benefit of planning permission. The planning department also needed to identify the owners of a number of the properties concerned. The investigations were ongoing and the planning department would take the necessary enforcement action in due course. Councillor Purcell requested that a further report be presented to the committee for the next meeting that would include a list of the buildings in question.

Leixlip Youth and Community Centre, Newtown House

The following motion was considered in the name of Councillor McGinley:

That the issues with the Leixlip Youth and Community Centre, Newtown House (roofing, lighting/electricity supply, sewage, etc) be addressed without any further delay.

Mr Perry reported that the housing department were in the process of seeking legal on some of the issues and that a list of works to be carried out was being compiled; he also reported that there was a problem with securing funding for the necessary works to be completed. Councillor Murphy reported that the problem with the building was getting        worse by doing nothing and that the roof in particular needed urgent attention, she suggested that Leixlip Town Council maybe in a position to help fund the works.

Resolved: That the housing department contact the town council to see if they could assist in funding the repairs to Leixlip Youth and Community Centre.

Standing Orders and Closed Sessions

The following motion was considered in the name of Councillor Murphy:

That the public and press are admitted to all Celbridge Area Committee meetings, except where a vote is taken to exclude them, in line with section 19 of the standing orders.  In cases where an agenda issues for a closed session, that minutes are taken and           circulated afterwards, in cases where the subject under discussion at area meetings           requires a decision, such a decision is postponed until it can be taken in open session.

      The meetings administrator reported that Standing Orders allow for closed sessions of  committees by agreement of the members "to allow for discussion of  private and confidential matters". While members had discretion in this matter, they may prefer to consider some issues in private. It was not considered that the present use of closed sessions conflicts with standing orders or legislation governing public access to meetings. Councillor Murphy reported that no vote had been taken and that this council were in breach of the legislation in place. The meetings administrator agreed that no vote had taken place, he explained that this could happen when matters arise outside of the usual motions and questions, i.e. other business: which was what had occurred with this particular item. A long discussion ensued regarding closed sessions and it was agreed by all that the members would vote on whether they would discuss “sensitive issues” in a closed or open session. A vote took place regarding “Laurel Lodge” and it was agreed to discuss this item in an open session at the December meeting. The issue regarding the erection of a boundary fence was also raised and Councillor Kelly asked how much this would cost.

Resolved: that “Laurel Lodge” be discussed in an open session at the December meeting.
