Minutes and Progress Report
The committee considered the minutes of the monthly meeting held on 18 March 2011. Resolved on the proposal of Councillor McGinley and seconded by Councillor Purcell that the minutes be confirmed and taken as read.
Undergrounding of Wires in Main Street, Celbridge
An Cathaoirleach asked that the council enter into discussions with the Leader programme as this had been a longstanding issue that needed to be rectified as soon as possible.
Traffic problems, Laurence Avenue, Maynooth
It was reported that this was a complex issue and a meeting could be arranged on site with the roads design section, An Cathaoirleach asked that this on site visit take place as soon as possible as there was a serious traffic problem here and that it was an accident waiting to happen.
The Spa Well, Leixlip
The Parks Superintendent reported that existing works would be completed in the next month. Councillor Purcell queried the existing works, did this include all works or just small ground works, he asked if the canal toll restoration would be completed aswell
Process with receiver in Meadowbrook estate
The members asked that this item be discussed at the May area committee meeting for an update on the outcome of court proceedings.
Unauthorised Development, Leinster Park, Maynooth
It was reported that the open space in question was never in the ownership of the council and could only be transferred to public ownership by consent of the landowner. However, the developer was required to comply with the conditions of planning permission prior to the commencement of development. It was also reported that the developer had not yet submitted a commencement notice and that there was no court injunction in respect of the unauthorised development. The planning department would continue to monitor this development. Councillor McGinley asked for a further report for the May meeting.

Laurel Lane
To receive update on Laurel Lane, Celbridge.
Planning report: A warning letter was issued on the 8 February 2011 and the timeline for response to same expired on the 8 March 2011. No response has been received to date. Subsequent inspection was carried out and the finalised report recommended the serving of an enforcement notice.The enforcement notice was served on the 11 April 2011
Environment report: Derelict site: Kildare County Council received confirmation from the Solicitors acting on behalf of property at Laurel Grove on November 25, 2010 that the property was to be offered for sale. As a result, it was decided to allow 6 months for progress on the sale. The position would be assessed at end of April.
Odour issue
In November 2010, the operator of the motor business was requested by the environment section to maintain a log of spray painting activities taking place at the premises. The complainant was also requested to maintain a log of any odour incidents in the area. Such logs were requested to be maintained for a two month period, until the 14 January 2011.
Kildare County Council has received the log maintained by the motor business operator and was still awaiting the log kept by the complainant. The complainant had been contacted and would forward log shortly. Both logs would then be assessed to determine next course of action. In the interim, Kildare County Council has carried out its own odour assessment on the 14 January. The assessment took place at areas surrounding the vehicle refinishing installation and also adjacent to the complainants residence. Seven locations were identified for the assessment and at five locations the odour rating for Odour Persistence and Odour Intensity was recorded as nil, indicating no detectable odour.
At two of the locations assessed, the odour rating for Odour Persistence and Odour Intensity were both recorded as 1, indicating that a very faint odour was detected intermittently during the period of assessment but the Inspectors needed to stand still and inhale facing the wind in order to detect the odour. However, the faint odour detected at the two locations could not be determined as odours emanating from the motor business. The odour assessment concluded that no odours were detected from the motor business. The environmental section said that they would inform the members of any progress on this matter. It was also reported that this matter had been referred to the Ombudsman, were 3 issues had been raised and after the process had been complete the complaints had been upheld by the Office of The Ombudsman, Mr Minnock also reported that only one issue remained regarding an enforcement matter which was still being investigated.

National Transport Authority Programme
To discuss the National Transport Authority Programme.
The Traffic Management Engineer attended the meeting to discuss the NTA’s programme and grant allocation for 2011, he stated that the report would be circulated to all members of Kildare County Council shortly; he also reported that funding had been secured for the implementation of the required infrastructure to facilitate the extension to bus routes 66 and 67. An Cathaoirleach and the members all agreed that they were happy that funding had finally been secured for the much needed bus route extension. Mr Hodgins also reported that the council may be able to apply for funding for the undergrounding of wires in Main Street, Celbridge, it was reported that the required ducting was already in place which would minimise the overall cost of the works, Councillor McGinley stated that the council should also write to the ESB asking them to contribute to the overall costs. Councillor Purcell agreed with Councillor McGinley and suggested that all utility companies in question be written to and be asked to make a “goodwill” gesture towards funding the undergrounding of wires in Celbridge.
Resolved: that the roads department write to the utility companies asking them to contribute to the undergrounding of wires in Main Street, Celbridge.

Right of way at Beatty Park
To discuss right of way at Beatty Park / Shackleton Road, Celbridge.
The roads department reported that they had completed the statutory extinguishment of right of way procedure as prescribed in Section 73 of the Roads Act, 1993. The Beatty Park Residents Association was advised that the statutory procedures had been completed by the Council and that the physical closure of the public right of way could take place without prejudice to any private rights (if any). That remains the situation, i.e. that the Beatty Park Residents Association may carry out the physical works to close the public right of way without prejudicing any private rights (if any). The director of services of the roads department stated that this was a highly contentious situation and that there were strong points on both parts regarding the closure of the right of way, and that the decision to proceed with the closure had not been taken lightly by the council.
Resolved: The report was noted.

Car parking at Church of the Nativity, Leixlip
To discuss car parking at Church of the Nativity, Leixlip.
The roads department reported that survey of usage of the Church car park was circulated to the members in the context of the review of the Leixlip Parking Bye-Laws. As indicated to the members already the transportation department felt that the car park at the Church of the Nativity should be regulated and included in the Leixlip Parking Bye-Laws. However, the adoption of the bye-laws was a reserved function and, as such, this decision rests with the members. Ms Kavanagh reported that the results of the survey had been circulated to each member prior to the meeting and that the roads department were ready to enter into discussions regarding the parking bye-laws, Councillor Purcell stated that he and Councillor Byrne had visited the site and observed cars being parked and their drivers then using public transport, he also reported that the same problem was occurring in Ryevale Lawns and asked that the council investigate and rectify this problem. Councillor O’Rourke also spoke to residents regarding this ongoing problem and asked that a special meeting take place with the residents, members and council staff to discuss this item further. An Cathaoirleach said that the parishioners wanted the parking to be regulated as soon as possible and proposed that the council install the machines and regulated the parking issues as soon as possible, this was seconded by Councillor O’Rourke, Councillor Larkin stated that there were multiple problems at this location and that it all stemmed from the lack of parking in Leixlip, and that a solution was needed for the entire town.
Resolved: That a special meeting take place to discuss this matter further.

Road safety issues, Celbridge/Templemills/Ardclough Road
The following motion was considered in the name of Councillor Griffin:
That for health and safety reasons the council roads design team, examine the Celbridge/Templemills/Ardclough road with a view to making it safe for those pedestrians who have to use this route into Celbridge and that furthermore that they provide costing and a source of funding to carry out the works.
The roads department reported that there were no requirements or obligations under health and safety legislation for councils to make junctions safe. However, given the level of concern raised about the road safety at the junctions, a recommendation was made in the Celbridge Traffic Management Plan to improve the junctions.
Finance for any improvement works at the junctions remained dependant on central government sources and therefore, council officials would raise this matter with the NTA at the next monitoring meeting. An Cathaoirleach said that the report did not answer the question and asked that the roads department re-investigate, he reported that the footpaths on this road were too narrow and that people with buggies and wheelchair users must enter onto the public road to get to their destination, Councillor Byrne agreed with An Cathaoirleachs remarks and stated that this was an ongoing problem which was first raised a few years ago, Councillor O’Rourke stated that this problem needed to be rectified as soon as possible.
Resolved: That the roads department re-investigate Councillor Griffins motion and that the council apply for funding from the NTA under the heading of accessibility.

Repair of ramps, Church of Ireland, Straffan
The following motion was considered in the name of Councillor Griffin:
That the council repair the traffic calming ramps at the Church of Ireland in Straffan.
The roads department stated as previously indicated to the members, unless funding was made available to the area office, these ramps could not be repaired. An Cathaoirleach reported that the quality of the old ramps was much better. i.e. the tarmacadam ones that were installed by council staff, he asked that the council re-visit this item and repair or reinstate the ramp. Councillor O’Rourke agreed with An Cathaoirleachs comments.
Resolved: That the area office re-investigate this item with the intention of repairing or reinstating the ramp in question.

Parking problems in of Riverdale, Leixlip
The following motion was considered in the name of Councillor Griffin:
The residents of Riverdale, Leixlip are finding it extremely difficult to exit / enter their homes because of the inconsiderate car parking in the estate. The roads section are requested to examine and provide a solution.
The roads department reported that the options available were the installation of double yellow lines which would restrict all parking in certain areas of the estate or the inclusion of this estate in the area covered by the Leixlip Pay Parking Bye-Laws. Further consideration of these options was required. An Cathaoirleach said that he could forsee problems with emergency vehicles entering this estate due to the parking problems. Councillor Purcell agreed with An Cathaoirleachs remarks.
Resolved: that the roads department investigate the possibility of installing some sort of parking regulations or road markings in the estate.

Repair of road, parking area, Course Moone, Straffan
The following motion was considered in the name of Councillor O’Rourke:
That the council repair and the resurface (surface dress) the small car parking area at Course Moore, Straffan, (details supplied).
The area office reported that the cost of this resurfacing was €1,900. If funding was made available this work could be carried out by the area office.

Repair of Footpath,Course Moone, Straffan
The following motion was considered in the name of Councillor O’Rourke:
That the council repair the footpath at Coarse Moore, Straffan, (details supplied).
The area office reported that this footpath would need to be replaced which would cost €8,500.

Dangerous entrance, G.A.A. grounds, Hazelhatch Road, Celbridge
The following motion was considered in the name of Councillor Byrne:
That the council address the very dangerous entrance to the G.A.A grounds on the Hazelhatch Road as this is extensively used by school traffic and Hazelhatch Railway Station, Celbridge.
The roads department reported that this motion referred to an entrance to private property. The only input that Kildare County Council would have is if the GAA, or the School, apply for planning permission to change the entrance.

Raised footpath, from roots of trees, Celbridge
The following motion was considered in the name of Councillor Byrne:
That the council repair the footpath outside house (Details Supplied), Celbridge as several people have fallen there.
The area office reported that there was a tree here which was causing the “trip” on the footpath so this would need to be removed and the footpath repaired. This would cost €900.00. Funding would need to be made available to the area office to carry out this work.

Resurfacing of road, Grove Estate, Celbridge
The following motion was considered in the name of Councillor Byrne:
That the council resurface the road between the entrance to the Grove Estate Celbridge and the bridge.
The roads department agreed that this stretch of road was in need of an overlay of tarmacadam, unfortunately there was no funding in the current roads maintenance budget. The work would cost in the region of €51,000.

Fencing for Riverdale estate, Leixlip
The following motion was considered in the name of Councillor Larkin:
That a suitable fencing arrangement is installed, the design of which is to be agreed with the Riverdale residents association, at the lowest point in the wall dividing estate and Captains Hill, the reason the fence is required is to reduce the missiles thrown from this location.
The roads department reported that a quotation would have to be sought from a fencing company to erect a security fence along this section of wall. Funding would need to be provided as there would be no funding in the roads maintenance budget for this project. Councillor Larkin asked that a costing for the required fence be prepared for the May meeting, Councillor McGinley agreed with Councillor Larkins remarks and added that the fence would not be too expensive, Councillor Purcell also added that adequate fencing needed to be installed that served a purpose and fitted in with the surrounding area.
Resolved: that the roads department get a quote for the required fencing to be installed.

Bin trucks entering housing estates
The following motion was considered in the name of Councillor Purcell:
That the council outline the necessary means whereby a reduction in the number of bin trucks entering estates is achieved.
The roads department reported that this was a matter for the environment department, in relation to the council’s own refuse collection service, and perhaps the planning department in the context of the planning for new estates. The transportation department had no function in this regard. Councillor Purcell said he was unhappy with the response and added that there was no regulation of bin collection times, he also added that because of this trucks were entering estates at very early hours of the morning which was disturbing residents and that there was also a health and safety issue with the entering estates at certain times of the day, Councillor McGinley agreed with Councillor Purcells remarks, An Cathaoirleach added that this was a difficult issue to resolve and suggested that this item be discussed at the next environment spc.
Resolved: That the issue of regulating bin collections and the times that they are collected be discussed at the next environmental spc and that the planning department also take this matter into consideration when planning applications are being assessed for new housing estates.

Road improvements, Colaiste Chiarain, Leixlip
The following motion was considered in the name of Councillor Purcell:
That the council produce costings for road safety improvements on Celbridge road near Colaiste Chairain, Leixlip. The report to include the cost of pedestrian crossing, bus friendly ramps, signage etc.
The roads department reported that the cost of the pedestrian crossing, including civil works, would be in the region of €25,000 and the cost of the ramps, including signage, would be in the region of €30,000. The total cost of the works would be approximately €55,000.

Repair of manhole and gully, Dublin Road R.H.S
The following motion was considered in the name of Councillor O’Rourke:
Can the council look at repairing the road surface around a manhole and gully on the Dublin Road R.H.S as you leave Celbridge (opposite the 5 detached houses before the garage)?
The roads department reported that this was on a list for attention as soon as manpower becomes available.

Official naming of road, Celbridge
The following motion was considered in the name of Councillor O’Rourke:
Can the council permanently name and plate the link road between R405 and Shackleton road in Celbridge as “Aghards Road”?
The roads department reported that if the members wished to name this road the Aghards Road then this could be facilitated.
An Cathaoirleach also enquired about the “ Shackleton Road ” in Celbridge and if that would be officially named.
Resolved: That the roads department inquire about the naming of what is locally known as the “Skackleton Road”.

Yield sign, exit at Ballyoulster, Celbridge
The following motion was considered in the name of Councillor Byrne:
To ask the council to provide a yield sign where the exit at Ballyoulster meets the horseshoe leading to the Dublin Road?
It was reported that this request had been referred to the roads design section for comment as this would change priority here. There were two stops at the exits onto the regional road. When the roads design section have investigated this matter a report would be presented to the members.

Removal of tree that damaged footpath
The following motion was considered in the name of Councillor Byrne:
To ask the council to repair the footpath at houses (details supplied), where inappropriate tree planting has caused the path to rise and is a hazard for pedestrians?
The roads department reported that this large tree would need to be removed and a large section of footpath replaced which would cost €6,100.

Sponsorship of roads
The following motion was considered in the name of Councillor Griffin:
Some counties have arranged for the sponsorship of approach roads to various towns. Is it possible for council as part of a pilot scheme, working in conjunction with the local tidy towns in the Celbridge area to arrange a scheme to enhance the approach roads to these towns?
The roads department reported that the sponsorship of roundabouts was being considered by the Transportation SPC. As the sponsorship of roads was a related matter perhaps the Transportation SPC’s brief could be widened to include Councillor Griffin’s suggestion.

Status of bus lane, Moyglare/Kilcock Road
The following motion was considered in the name of Councillor Griffin:
What is the status on the bus lane on the Kilcock Road / Moyglare Road, Maynooth?
It was reported that an application was made for funding for the scheme in late 2010 to the National Transport Authority. No confirmation of funding had been received to date. Also see item CE03/04/2011

Cleaning of Cycle lanes
The following motion was considered in the name of Councillor Purcell:
Will the council keep cycle lanes free from debris and glass by a regular sweeping programme?
The area office reported that a large suction sweeper could sweep the cycle tracks which were on the public road. However, if the cycle tracks were on the footpaths the suction sweeper could not sweep them. Unfortunately the area office does not have the manpower to sweep all the paths as they were fully occupied with the road restoration grants. Councillor Purcell suggested that the cycle lanes be inspected regularly which would enable staff to determine if a particular area needed to be cleaned immediately. Councillor O’Rourke also praised the area office staff for there hard work in the Celbridge area.

Lights on Rye bridge, Leixlip
The following motion was considered in the name of Councillor Purcell:
Would the council arrange to have the lights on Rye Bridge, Leixlip replaced or even cleaned.
The roads department reported that this issue would be examined by the public lighting section and would be reported to our public lighting maintenance contractor for repair.

Skate park for Celbridge area
The following motion was considered in the name of Councillor O’Rourke:
That the council identify a site\location in Celbridge to provide a skate park and any other additional facilities which could be provided for the teenagers of the area. Funding etc to be considered.
It was reported that Kildare County Council would like to develop a teen facility within Celbridge. However a number of issues would have to be addressed before this facility could be provided. Firstly the location. There was a shortage of amenity land and associated suitable sites to provide such a facility. Consideration was given to providing a facility at Willowbrook Park in conjunction with the existing playground however due to ongoing issues relating to antisocial behaviour local residents were not in favour of such a proposal. Secondly finance would have to be provided to facilitate a teen facility and at present there was no provision for financing such an amenity in the capital programme.
Finally the design of the facility is another factor which requires consideration. The work carried out by the students in Celbridge in relation to a skatepark was an excellent start to this process however due to the cost of constructing such a facility further consultation may be necessary to ensure that its design reflects what teenagers would use and further elements within the design besides a skating element maybe required.It was hoped with active participation from the Celbridge Community that these issues could be discussed further and resolutions sought so that a facility for teenagers could be provided within Celbridge. Councillor O’Rourke said that he would try to organise a survey with local young people and their parents to determine the best location for a skate park.

Criminal damage to houses in Celbridge
The following motion was considered in the name of Councillor Purcell:
That the council can give a report on recent criminal damage to houses in Celbridge and Leixlip. Further that the council give details as to who will pay the bill for this damage.
The housing department reported that they did not have a role in the investigation of criminal activities which were the responsibility of An Garda Siochana. The repair of damaged council property as a consequence of criminal damage was generally considered in the context of any report received from An Garda Siochana. Councillor Purcell stated that this was a very serious matter and asked that the council liaise with the local gardai to ensure that this would not happen again and that those responsible be made accountable for their actions, he also asked that the council enforce the conditions in the tenancy agreement which is signed by each tenant prior to occupancy of a house owned by the local authority, the members were unable to discuss this matter further as any further discussion or comment could jeopardise the garda investigation.

Skate park for Celbridge
The following motion was considered in the name of Councillor Larkin:
That the Celbridge area committee seek to include a skate park based in Celbridge, as an initiative for funding in the new development contribution scheme.
It was reported that there was no provision in the current capital programme for the provision of a skatepark in Celbridge. However consideration could be given to its inclusion when the capital programme was next reviewed. In addition to the finance of such a project other factors need to be considered these were:
1. There was a shortage of amenity land and associated suitable sites to provide such a facility. Consideration was given to providing a facility at Willowbrook Park in conjunction with the existing playground however due to ongoing issues relating to antisocial behaviour local residents were not in favour of such a proposal.
2. The design of the facility was another factor which would require consideration. The work carried out by the students in Salesians College Celbridge in relation to a skatepark was an excellent start to this process however due to the cost of constructing such a facility further consultation may be necessary to ensure that its design reflects what teenagers would use and further elements within the design besides a skating element maybe required. Councillor Larkin asked if the council would consider a shared location that would be accessible and within easy reach of Celbridge, Leixlip and Maynooth, Councillor Byrne suggested that the council owned lands at the Salesian College would be an ideal location as they were zoned for “leisure purposes” and also a good locationCouncillor McGinley said that the design of such an area would be very important and he also suggested that the Harbourfield in Maynooth would be an ideal location due to the previous works carried out. Mr Minnock said he would pass on the councillors remarks to the Parks Superintendent for consideration.
Resolved: That the parks department investigate the Harbourfield, Maynooth as an ideal location for a skate park

The wonderful Barn
The following motion was considered in the name of Councillor Larkin:
Is there any further conversation / reconstruction work planned for the wonderful barn?
It was reported that James Howley, Conservation architect, of Howley Hayes Architects, had issued the practical completion certificate to Rainey's for the repair and re-instatement works to the upper sections of the folly known as the Wonderful Barn. In addition, the invasive ivy had been removed from the pigeon loft/follies and the perimeter stone wall. All works had been carried out sympathetically and in keeping with traditional/ authentic conservation principles, and are pleased with the outcome, to date. The Contractor was to return the keys to the council during the week commencing 4th April. Survey work was also done on the original house. The council had applied to the Heritage Council for more funding to continue our restoration works with the assistance of James Howley.
Heritage Council funding was severely cut in the 2011 budget, but they indicated that they had a €250,000.00 for support works for, perhaps, three project of national interest.The council await their decision. Access can be pre-arranged with Stephen Dunne, the facilities manager but public access, even on a limited was not envisaged at the moment. Report was noted.

Removal of Large cherry tree
The following motion was considered in the name of Councillor O’Rourke:
Can the council remove the trees which are outside houses (details supplied), as it is creating safety concerns etc for the occupier of the house?
The parks department reported that the tree in question was a mature cherry tree. An inspection of the tree found that it was in good condition and was of important amenity value to the area. It was not therefore proposed to remove the tree however it would be considered for pruning in the next programme of tree works later in the year.

Removal of Whitebeam and Maple tree
The following motion was considered in the name of Councillor Purcell:
Would the council remove trees at (details supplied), to enable the residents to have normal services such as Sky TV?
The parks department reported that an inspection of this location found that there were no trees directly outside this property, however there were two trees either side of the front of the property. The tree to the right was a mature Whitebeam and the tree to the left was a mature Maple. Both were in good condition and of important value to the area. Therefore it was not proposed to remove either tree. However the crown of the Maple tree was relatively big and would be considered for some pruning as part of the next pruning programme which would be carried out later in the year.

Barrier,Black Avenue
The following motion was considered in the name of Councillor Larkin:
Now that the barrier is in place at the end of Black Avenue, what are the arrangements for opening and closing the barrier and what hours does that apply to?
The housing department reported that arrangements for the barriers at the entrance to St Catherines Park / Black Avenue were that the barriers would be operated by the staff in the sewerage treatment plant in conjunction with Fingal County Council. The opening and closing hours are as follows
November, December, January: 9.00am – 5.00pm
February & March 9.00am – 6.00pm
April , October 9.00am – 7.00pm
May, September 9.00am – 8.00pm
June, July, August 9.00am - 9.00pm
Signs would be erected at the entrance to Black Avenue in the next 3 weeks to inform patrons of these operating times.

Pipe, Shinkeen River
The following motion was considered in the name of Councillor Byrne:
To ask the council to seek way leave to pipe the Shinkeen River at the entrance to the G.A.A grounds Hazelhatch Road, Celbridge to prevent flooding?
It was reported that the water services section would investigate this issue and report back to the next meeting of the Celbridge Area Committee.
Resolved: That the water services section report on this item for the May area committee meeting.

The water services section reported that the Kildare Water Strategy Phases 1A/B - Castlewarden to Ballygoran Pipeline and Reservoir Scheme which was being delivered under the Water Services Investment Programme (WSIP) 2010 - 2012 published in April 2010, included for the provision of 13km of new 900mm diameter watermain, a new 20ML capacity reservoir at the Ballygoran site (which would augment the existing reservoirs (10ML capacity) on site). The council in advancing this contract had completed the design and had commenced the procurement process for selection of a contractor. (contractors have been pre-qualified for invitation to tender).
The contract documents had been submitted to DoE for approval prior to going to tender. It was envisaged that tenders would be invited by April / May 2011 with a view to starting construction of the Scheme by Q4 2011. It was envisaged that the reservoir would be fully commissioned by Q4 2013.The pipeline element of this project would augment the existing supply infrastructure serving north east Kildare by Q4 2012. An Cathaoirleach asked that the members receive a briefing on this item within the coming weeks regarding water pressure etc.
Resolved: that water services staff attend the next meeting to discuss this matter in greater detail.

Flood alleviation in Celbridge electoral area
The following motion was considered in the name of Councillor Larkin:
What application if any has been made to the OPW for funding in 2011 in respect of flood alleviation in the Celbridge electoral area?
The water services department reported that to date the OPW had not invited applications for funding under the Non Coastal Minor Works and Studies Scheme for 2011. In the meantime each area committee had been consulted to prepare a list of works for inclusion in a submission to the OPW.
However, funding had been secured for the Ardclough Flood Alleviation Scheme and it was hoped to present this scheme to Kildare County Council for approval by way of Part 8 resolution at the May meeting. Under the current programme for this scheme work could commence on site, pending relevant approvals, landowner agreements etc., before the end of this year. Councillor Larkin reported that Duncarrig was a major problem and asked that it would be considered, it was reported during the meeting that this area had been added to the list for consideration previously.
