Planning
10. To consider material contravention of the Development Plan for the County of Kildare
(2005-2011) in respect of planning reference number in Register 06/2930.
The development consists of 6 no. 3 bed detached bungalows,16 no. 3 bed semi
detached bungalows, 16 no. 4 bed detached bungalows, 5 no. 4 bed dual aspect
bungalows, 16 no. 5 bed bungalows, 1 no. 5 bed dual aspect bungalow, 9 no. 6 bed
bungalows, together with all associated drainage, services, boundary wall treatment,
site works, landscaped open spaces, 1 no. vehicular access road, tennis court,
basketball court and children’s playground at Bawnogues, Straffan – applicant
Mr. Martin Flannery.
The development would contravene materially Section 6.7.6 of the County
Development Plan 2005-2011 which states:” Where an area is not within an identifiable
settlement, and is not otherwise zoned as part of this development Plan, or of any of the
town development plans, the use of such land will be deemed to be primarily

11. To consider material contravention of the Development Plan for the County of Kildare
(2005-2011) in respect of planning reference number in Register 07/1829.
The development consists of construction of a new single storey detached Community
Centre, incorporating office space, kitchenette, sanitary accommodation and storage
space, with all associated site works at the corner of Assumpta Terrace, Ballymore
Eustace – applicant Ballymore Eustace Community Development Association.
The development would contravene materially Section 25.4 of the County Development
Plan 2005-2011, which states: “The zoning objective in this case is to provide for low
density residential development.” (report to follow)
12. To consider material contravention of the Maynooth Local Area Plan 2002 in respect of
planning reference number in Register 08/97.
The development consists of 1105 sq. m. two storey, 8 classroom primary school
building including staff and pupil facilities, teaching support rooms and ancillary spaces
and all associated site works including play areas, paths, perimeter boundary fencing,
secure fencing and 2 no. new vehicular entrances onto the public road (R405) with set
down and parking areas at Railpark, Celbridge Road, Maynooth, Co. Kildare - applicant
Minister of Education and Science.
The development would contravene materially Section 3.6.1 of the Maynooth Local Area
Plan 2002, which states, “to retain and protect agricultural uses”. (report enclosed)

22. Councillor Mc Evoy
That a report be given on what strategy we have for dealing with discarded rubbish
along roadsides, in ditches and other such locations and can our resources in this
regard be increased to cope with a deteriorating situation.

That the council considers whether it should have a policy, as is now being applied in
other local authorities, of relating planning approval to the availability of specified
infrastructure, declared in advance, and thus relieving applicants of the burden and
expense of preparing complex applications which are doomed in advance.

That all objections, submissions and letters of support for planning permission files be
accompanied by a copy of driving license or passport from person making submission,
where a submission is being made on behalf of a group it must be accompanied by
identification from one or more persons associated with the submission.

That the recent practice of preparing local area plans without inviting pre draft
submissions be suspended immediately and further more that any decisions to change
the policy or practice of the manner in which this process is dealt with should be made
by the planning authority.
26. Councillor Kelly
That Kildare County Council in consultation with Sustainable Energy Ireland, select a
town in Kildare in which to set up a Sustainable Energy Zone, with a view to promoting
the concept in other towns throughout the county in due course, and that the model of
the Dundalk S.E.Z. be used to inform this process.
