Planning

6.      To consider material contravention of the Kildare County Development Plan 2005 - 2011

in respect of planning reference number in Register 07/2504.

The development will consist of a new primary school incorporating temporary classrooms, consisting of four prefabricated single storey double classrooms with a total area of 488 m. sq sanitary provisions, car parking area, play area, pumped sewer and associated works at Kilmalum, Blessington, Co. Kildare – applicant Board of Management of Gaelscoil Na Lochanna.

The proposed development would contravene materially Section 6.7.6 - OD1 of the County Development Plan 2005 - 2011 which states: Apart from housing development there are other land uses which may be considered in the rural countryside.  Where an area is not within an identifiable settlement and is not otherwise zoned as part of this Development Plan or of any of the Town Development Plans the use of such land will be deemed to be primarily agricultural (report enclosed)

 

7.      To consider material contravention of the Kildare Town Local Area Plan 2002

in respect of planning reference number in Register 07/1211.

The development will consist of modifications to part of the development previously granted planning permission under Reg. Ref. 02/2974 which consists of the neighbourhood centre area of the overall scheme.  The development granted permission under Reg. Ref. 04/2974 (the parent permission) consisted of a mixed-use scheme over an application site area of 40.4 hectares.  The development currently proposed consists of modifications to building nos. 8.1, 8.2, 8.3, 8.4 and 7.5(c) proposed under the parent permission on an overall application site area of 1.7 hectares (4.2 acres) located in the centre of the parent planning application area. The heights and footprints of building nos. 8.1, 8.2, 8.3 and 7.5(c) as proposed under Reg. Ref. 04/2479 are to remain unchanged in the proposed development, however, the uses proposed within are to be altered as follows resulting in modifications to elevational treatments:

Building 8.1: Retail use is proposed for the ground floor and 2 no. 2 bed residential units are proposed for the first floor.  Under Reg. Ref. 04/2974 workshops on the ground and first floors were proposed. 

Building 8.2: Retail use is proposed for the ground floor and 2 no. 2 bed residential units are proposed for the first floor.  Under Reg. Ref. 04/2974 workshops on the ground and first floors were proposed. 

Building 8.3: Retail use is proposed for the ground floor and 6 no. 2 bed residential units are proposed for the first floor.  Under Reg. Ref. 04/2974 workshops on the ground and first floors were proposed. 

Building 7.5(c): Retail use is proposed for the ground floor medical and dental clinic on the first floor.  Under Reg. Ref. 04/2974 offices on the ground and first floors were proposed. 

Building 8.4 which consisted of local retail on the ground floor and doctor and dentist surgeries on the first floor under Reg. Ref. 04/2074 is to be omitted and replaced with 10 no. residential units consisting of 6 no. 2 bed units, 2 no. 3 bed units and 2 no. 4 bed units at Greyabbey, Kildare Town - applicant Curtmount Properties Ltd.

The development would contravene materially Section 3.2.7 of the Kildare Town Local Area Plan 2002, which states: This zoning provides for new warehousing and industrial development excluding retail warehousing.  The office content of any development should not be greater than 20% of the total floor area and be ancillary to the industrial or warehouse use.  Other uses, ancillary or similar to industry and warehousing will be considered on the merits of each planning application and may be acceptable in this zone. That any development on the Concrete Pipes /Donnolly Mirrors sites should include the beginning end of a future ring road around the town with the other end to be at the roundabout serving Lidl, B&Q and the current new ring road linking the Newbridge Rd. and the Caragh Rd.

17. Councillor McGinley

That it is hereby resolved and accepted as council policy that housing applicants will not be removed from the waiting list where it can be established that they have a continued housing need e.g. by being in receipt of rent subsidy, income record etc., and that applicants who do not meet deadlines for review of their applications are not required to forfeit their place on the waiting list and start from scratch and that the annual review procedure be examined to see if a simpler format could be devised for the application form.

 

18. Councillor Byrne

A large proportion of motorcycle accidents resulting in serious injury and deaths are directly related to road conditions and in particular to road repairs. In light of this I call on Kildare County Council to insist that road works be finished to a high standard for all road users, and that in particular the practice of "bedding in” new surfaces be stopped, and adequate warning of road works be monitored on a daily basis.

19. Councillor Power

In the interest of making area meetings more relevant and also with the intention of keeping council meetings shorter, that this council be informed of all the powers that can be allocated to the Naas Area Committee from the County Council and, with the agreement of the council and the area committee, that these powers, or such powers as council and the area committee agree, be transferred/allocated to the area committee.

 

20. Councillor Mc Namara

That the County Manager informs the council of the following in relation to the Social Housing Investment Programme (SHIP);

(a)   What was the total allocation made to Council in 2008?

(b)   To itemise the breakdown of this sum under its various headings.

(c)   In relation to Circular N23/07 what sum does the council have available from its

own resources to assist the SHIP.

(d)   Within the total budget for this year how many new schemes will be commenced in 2008?

 

21. Councillor Nolan

That in all future housing developments adjacent or close to main roads, dual carriageways and motor ways, that the developer be responsible for the provisions and installations of adequate sound barriers, and that these barriers comply with the usual standards that are required.
