3.   To approve disposal of the following lands at:

(a)  60 Riverforest View, Leixlip, Co. Kildare.

6.      To consider material contravention of the Kildare County Development Plan 2005 - 2011

in respect of planning reference number in Register 06/2674.

The development will consist of two storey and single storey 92 bedroom nursing and convalescing home facility, which incorporates (a) Reception foyer, 50 no. ensuite bedrooms, oratory, staff rooms, kitchen, day rooms, sitting rooms, laundry, dining room, stores, all on ground floor, (b) 42 no. ensuite bedrooms with kitchen, staff accommodation, laundry, stores and dining room and all associated facilities on the first floor, (c) 40 no. single-storey two bedroom retirement terrace homes in form of courtyards with car parking and landscaped areas, (d) single storey 42.8 sqm convenience shop attached to terraced housing, which includes store and toilet to cater for the needs of the residents, (e) dormer building for community centre and two bedroom caretakers accommodation, (f) entrance to the complex from Alexandra Walk, Abbeylands, (g) car parking, landscaping, entrance gates, bin stores and all associated site works and all ancillary works at Abbeylands, Clane, Co. Kildare - applicant Brid and Karl Gallagher and John O’Connell.

The development would contravene materially Section 6.7.6 (OD1) the County Development Plan 2005-2011 which states: Where an area is not within an identifiable settlement, and is not otherwise zoned as part of this development Plan, or of any of the town development plans, the use of such land will be deemed to be primarily agricultural.

12. Clane Area

That the Clane Area Committee would urge the Council to put the necessary plans and resources in place in order to deal with the growing problem around surface water drainage.

13. Councillor Power

In the interest of making area meetings more relevant and also with the intention of keeping council meetings shorter, that this council be informed of all the powers that can be allocated to the Naas Area Committee from the County Council and, with the agreement of the council and the area committee, that these powers, or such powers as council and the area committee agree, be transferred/allocated to the area committee.

In the matter of development levies for 2007, 2006 and 2005 that this council be  informed:

(a) How much was levied?

(b) How much was collected?

(c) If it is known how much is yet to be collected?

(e) How it is known how much is to be collected?

(d) How much was spent?

         for each of the three years.

In the matter of work contracted to outside consultants for 2005, 2006 and 2007 that this council be informed:

(a) How much was spent on outside consultants?

(b) In what disciplines do these consultants operate, e.g., planning, road design, traffic

management, architecture, village/town/county development plans/surveys, house surveys, house repairs, legal advice, auctioneering, property procurement, water and waste water design/services?

(c) Within each of these disciplines, how much was spent?

16. Councillor Murphy

That Kildare County Council asks the Minister for the Environment Heritage and Local Government to bring forward an amendment to section 180 (2) (a) of the Planning and Development Act, 2000 to read as follows:  Notwithstanding subsection (1), where the development has not been completed to the satisfaction of the planning authority and enforcement proceedings have not been commenced by the planning authority within two years [currently seven years] beginning on the expiration, as respects the permission authorising the development,  of the appropriate period,  within the meaning of section 40 or the period as extended under section 42,  as the case may be,  the authority shall,  where requested by the majority of qualified electors who own or occupy the houses in question,  comply with section 11 of the Roads Act,  1993,  except that subsection (1) (b) (ii)  of that section shall be disregarded.



17. Councillor Murphy

Kildare County Council as part of the renewal of the county’s Major Emergency Plan does an assessment of the minimum personnel and equipment requirements       for dealing with such an emergency; that the flooding of August 9 is used to in such an actuarial assessment; that the triggering mechanisms for the Major Emergency Plan are altered to ensure should such an emergency re-occur the result would be the plan would be activated.

That in the case of new plots being purchased in graveyards that this council seeks to have the Death Grant increased by 50%.


19. Councillor Nolan

That Kildare County Council asks the N.R.A to clarify with the new Toll companies operating the M-50 on the following issues:

(a) How up to date is the technology for recording registration plates?

(b)Will the company who control the Tolls acknowledge that mistakes may have been made on billing issues, and what steps, if any, will they take to rectify same.
