Votes of Sympathy

 

The Mayor and members expressed sympathy with the following on their recent bereavements:

The family of Mary Downey, Corporate Services Department.

Marian Higgins, Library Service, on the death of her mother.

Adrian King, Transportation Department, on the death of his mother.

Mary O’Connor, Housing Department, on the death of her mother.

Joe Kelly, Transportation Department, on the death of his father.

Former Councillor Mary Glennon on the death of her son Tom Cahill.

 

Tributes were paid by members and the County Manager to the late Mary Downey and also to former Councillor Mary Glennon for her work as Mayor during the course of her son’s illness.

Confirmation of Minutes

 

The council considered the minutes of the monthly meeting held on 29 June 2009 and the annual general meeting held on 19 June 2009, together with the progress report.

Disposal of land

 

0.075 ha. approximately at Gorteenvacan, Castledermot

The council considered statutory notice dated 8 July 2009, which had been circulated to the members under Section 183 of Local Government Act 2001 signifying intent to dispose of 0.075 ha. approximately at Gorteenvacan, Castledermot, Co Kildare to Kathleen O’Connor, in consideration of payment of €1.00.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice.

 

0.1976 ha. approximately at Moyvalley

The council considered statutory notice dated 14 July 2009, which had been circulated to the members under Section 183 of Local Government Act 2001 signifying intent to dispose of 0.1976 ha. approximately at Moyvalley, Co Kildare to Geraldine Lynch, in consideration of payment of €29,862 and subject to existing tenants surrendering their interest on this part of the site and each party to be responsible for their own legal costs.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice.

 

0.28 ha. approximately at Graigues, Robertstown

The council considered statutory notice dated 8 July 2009, which had been circulated to the members under Section 183 of Local Government Act 2001 signifying intent to dispose of 0.28 ha. approximately at Graigues, Robertstown, Co Kildare to Desmond Parkinson, in consideration of payment of €100,000.00 and subject to all legal fees being borne by Desmond Parkinson.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice.

 

3.456 ha. at Lough na Mona, Leixlip

The council considered statutory notice dated 15 July 2009 which had been circulated to the members under Section 183 of Local Government Act 2001 signifying intent to dispose of 3.456 ha. at Lough na Mona, Leixlip, Co Kildare to Leixlip United Football Club, in consideration of payment of €543.00 per annum and subject to the following conditions:

§                Disposal to be by way of lease in accordance with Section 211 of the Planning and Development Act 2000.

§                The permitted user of the premises to be demised on foot of the lease shall be for the sole purpose of playing sport.

§                The lease will be for a period of 99 years and subject to a right of the Council to terminate the lease prior to the expiry of its term in the event that the user of the premises as permitted by the lease ceases at any time during its term.

§                The lease will be in a format reasonable approved of by Kildare County Council in conjunction with its law agent.

§                The legal fees of the Council in effecting this transfer shall be paid by Leixlip United Football Club.

§                The lands shall be developed by Leixlip United Football Club for sole purpose of playing sport.

§                Leixlip United will sub-lease 1.1278 hectares (2.787 acres) to Leixlip Town for the sole purposes of playing sport.

§                The reserved rent shall be five hundred and forty three euro per annum, reviewable every five years.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice, and subject to a condition that the lease allow the development of an adventure playground within the proposed lease area adjacent to the car park and proposed pitches.


 

1 Rosconnell Avenue, Newbridge

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 1 Rosconnell Avenue, Newbridge, Co Kildare to Kim Turner under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice.

 

2 Rosconnell Avenue, Newbridge

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 2 Rosconnell Avenue, Newbridge, Co Kildare to Andrea Furlong under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice.

 

3 Rosconnell Avenue, Newbridge

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 3 Rosconnell Avenue, Newbridge, Co Kildare to Aileen Smith and Declan Behan under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice.

 

4 Rosconnell Avenue, Newbridge

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 4 Rosconnell Avenue, Newbridge, Co Kildare to Sinead O’Connor and James Brennan under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice.

 

5 Rosconnell Avenue, Newbridge

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 5 Rosconnell Avenue, Newbridge, Co Kildare to Niamh Fleet under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 6 Rosconnell Avenue, Newbridge, Co Kildare to Adeolu Alade under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Kelly, pursuant to Section 183 of the Local Government Act 2001, that the council consent to the disposal of the land in accordance with the terms set out in the statutory notice.

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 7 Rosconnell Avenue, Newbridge, Co Kildare to Eamonn and Shalimar Gillen under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 8 Rosconnell Avenue, Newbridge, Co Kildare to Patrick McCabe and Siobhan O’Connor under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

The council considered statutory notice dated 6 July 2009 which had been circulated to the members under Section 183 of the Local Government Act, 2001 signifying intent to dispose of 10 Rosconnell Avenue, Newbridge, Co Kildare to Angela Ngaha and Denis Tchimaleu under the Affordable Housing Scheme (to include clawback) in consideration of €56,797 and subject to each the terms of the Affordable Housing Scheme.

Taking-in-Charge of Straffan Wood, Maynooth

 

The members considered a report from Mr Hannigan, Senior Executive Engineer, dated 22 July 2009, recommending the taking-in-charge of Straffan Wood, Maynooth.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Murphy, that the estate be taken-in-charge.

 

Councillor Murphy raised concerns regarding the layout of some estates, particularly mixed developments, and recommended that this issue be considered further during the review of the County Development Plan.  She made reference in particular to issues surrounding parking in estates, particularly where car parking spaces are physically removed from the dwellings they serve.  Councillor Kelly was concerned that increased densities permitted over recent years had resulted in less parking being provided.  While noting that legislation is expected in this area, Councillor Griffin raised concerns concerning the operation of management companies.

Material Contravention of the Kildare County Development Plan 2005-2011

 

The council noted that a planning application from Powercity (register no 08/1675) would, if successful, result in a material contravention of the Kildare County Development Plan 2005-2011

 

The development would consist of the construction of a single storey block, area 1800 sq.m, height circa 10.4metres, comprising warehouse area (1,100sq.m) and sales/display/showroom area (700 sq. m) and an external walled enclosure 90 sq. m, 2.6m high, to facilitate the recovery and recycling of packaging material and waste electrical and electronic equipment (W.E.E.E, facility) together with ancillary boundary treatment, landscaping, entrances, car parking, loading/unloading area and associated signage. This application is concurrent with a planning application to Naas Town Council for associated site entrance, car parking, delivery yard entrance and all associated site works, landscaping boundary treatment etc. at Southern Link Business Park, Jigginstown, Naas, Co. Kildare.

 

The development would contravene materially Section 23.11 Zoning Objective NE1 of the Kildare County Development Plan 2005-2011, which states: the zoning objective in this case is to provide for industrial and warehousing uses.  The purpose of this zone is to provide sites for industrial and in particular warehousing uses, at locations which are outside the built up area of Naas, and which are, or could be made with appropriate roads improvements, readily accessible to the national road network.

 

The Council also considered a report dated 24 July 2009 from the County Manager, which had been circulated to the members.  Mr M Kenny, Senior Planner, stated that no submissions had been received during the four week consultation period.  He added that, notwithstanding the current zoning objective for the site, as set out in the Kildare County Development Plan 2005-2011, the proposed development was considered an acceptable form of development at this location and was in accordance with the proper planning and sustainable development of the area for a number of reasons as set out in the County Manager’s report. 

 

Resolved on the proposal of Councillor Scully, seconded by Councillor Moore, with all 23 members present voting in favour, that a decision to grant planning permission be made in this case and that for that purpose the council consent to a material contravention of the Kildare County Development Plan 2005-2011.

 

In response to a query from Councillor L Doyle, Mr Kenny confirmed that a draft retail strategy for the county was currently being prepared and would be brought before Council for consideration.

Kilcock Local Area Plan 2009

 

Ms C Shinners, Senior Executive Planner, presented the Manager’s report dated 22 June 2009 which had been circulated to the members, noting that no submissions had been received during the display period of the amendment to the Kilcock Local Area Plan.  The amendment was on display from 7 May 2009 to 17 June 2009 in accordance with Section 20 of the Planning and Development Act 2000 (as amended).  She stated that the Kilcock Local Area Plan was adopted by Council on 27 April 2009.  The proposal before the members for consideration related to a change to the land use zoning map amending the zoning of 0.55 ha from “F” (Open Space and Amenity) to “B” (Existing/Permitted Residential) at The Paddocks, Highfield, Kilcock.  The subject lands were zoned “B” (Existing Residential/Infill) in the Kilcock Development Plan 2002.

 

Resolved on the proposal of Councillor Weld, seconded by Councillor L Doyle, with all members present in favour, that the Kilcock Local Area Plan 2009 be hereby made, pursuant to Section 20 of the Planning and Development Act 2000 (as amended), to incorporate the amendment proposed in the Manager’s Report dated 22 June 2009.

In considering the above items the members raised a number of issues including confirmation concerning the position regarding ring-fenced development contributions, the impact of affordable housing on the budget deficit, clarification regarding the status of the risk management policy, clarification regarding depreciation of assets (including roads), reduced motor tax receipts, expenditure on pre-letting repairs, long-term capital debt, review of capital expenditure and expenditure of development contributions.

 

Mr Hunter McGowan replied to the issues raised by the members.  In relation to the annual financial statement he stated that the statement must now be referred to the Local Government Auditor for audit, arising from which a subsequent report would be prepared.  He clarified the position relating to spending development contributions confirming that only contributions collected in the current year can be spent in 2009.  He set out the position with regard to expenditure on pre-letting repairs and clarified the reasons why motor tax receipts had reduced over the first half of the year, also setting out the position concerning the Local Government Fund.  He outlined the current position relating to collection of income, adding that expenditure and receipts were broadly in line.  He outlined the position regarding affordable housing and risk management.  He also advised the members that there had been some delays recently in recouping monies from the Department of the Environment, Heritage and Local Government.

Raising of loan for Water Services Projects

 

The administrator advised that a loan in the sum of €3.12m was required to be raised in order to carry out water services projects.  He confirmed that the Department of the Environment, Heritage and Local Government was agreeable to the raising of the loan by the Council for this purpose.

The members considered a report dated 13 July 2009 from Mr Minnock seeking approval to the raising of a loan for the Nás na Ríogh, Housing Association.

 

Resolved on the proposal of Councillor McGinley, seconded by Councillor Moore, the members approved the raising of a loan in the sum of €6,930,732 under Section 6 of the Housing (Miscellaneous Provisions) Act 1992 for the Nás na Riogh Housing Association Ltd.

Housing Progress Report

 

Mr Minnock presented the housing progress report.  Under the Social Housing Investment Programme [SHIP] he referred, in particular, to the funding allocation for the construction/acquisition programme and the loan approval for the Nás na Riogh Housing Association project under the Capital Assistance Scheme.  He confirmed that approval had been received for upgrading of units at Old Greenfield, Maynooth under the Energy Efficiency Plan.  In relation to the Vacant House Report, Mr Minnock advised that very few houses were now being shuttered and this had assisted in achieving savings. 

 

Members raised a number of issues including extent of the waiting list, the reduction in funding allocation, limited number of houses permitted to be purchased, increase in number of applications from tenants for transfer, improvement in turnaround of vacant houses noted, increased resources needed for Rental Assessment Scheme and the position regarding affordable housing stock.  Mr Minnock replied to the questions raised.  The members requested that the Housing Strategic Policy Committee consider how the housing construction programme would be delivered in the future.

Service Indicators Report 2008

 

The administrator referred to a report dated 15 July 2009 setting out the Service Indicators Report for 2008.  He added that the information contained in the document would form part of a national report.  Councillor Murphy suggested that a number of new indicators should be incorporated in the report such as the percentage of households with segregated waste, housing estates not yet in charge and civic amenity sites.  The meetings administrator said that the requirements of the service indicators were determined nationally.

Mayor’s Business

 

The Mayor wished the Kildare Senior Football Team well in their forthcoming quarter final match against Tyrone.

 

He referred to his recent visit to the new Castlefen housing development in Sallins and commented on the quality of the product being made available by the Housing Department.

 

He informed the members that the 25th anniversary of twinning with Lexington had recently been celebrated.  He stated that this twinning had proven to be very beneficial to the county and was very important from a business perspective.  He complimented the Council’s Choir and traditional group for the entertainment provided at the event.  He also complimented the staff who organised the event.

 

Councillor O’Donnell raised concerns regarding a change to signage erected by the National Roads Authority at the motorway exit for Kildare Town, adding that there was now no reference to heritage.  Mr Skehan informed the members that he was considering the matter and hoped to have a solution in the near future.

 

Councillor Heydon proposed that in the interests of public safety, the Council urgently request the National Roads Authority to leave the existing Athy to Ballitore Road (L8027) open onto the new N78 which was being constructed at present.  This proposal was seconded by Councillor Wall and agreed.

Retirement of Director

 

The County Manager advised the members that Mr Tommy Skehan was retiring from Kildare County Council and this would be his last Council meeting.  He said that he had worked with Mr Skehan in three local authorities and held him in very high esteem.  He added that he would be sadly missed by both his colleagues and the members.  The Mayor and members thanked Mr Skehan for all his work with Kildare County Council and wished him well for the future.

Breakdown Kits for Motorists

 

The council considered the following motion from the Transportation Strategic Policy Committee:

That the council recommend the making of legislation provision to require motorists to have breakdown kits (including high-visibility vests) in their vehicles for use in the event of breakdowns or other emergencies.

 

The County Manager informed the members that this proposal had come from the Transportation Strategic Policy Committee and, if agreed by the Council, it will be referred to the Minister for Transport.  Councillor Daly proposed an amendment to the motion that high visibility vests be stored in the front of the car and not in the boot.  This amendment was agreed.

Public Service Embargo

 

The council considered the following motion in the name of Councillor Murphy:

That we consider the impact of the public service embargo on the delivery of Council services.

 

Councillor Murphy advised the meeting that there were differing staff ratios in local authorities and the introduction of a staff embargo was of concern in counties such as Kildare where the staffing levels were modest.  She raised concerns that the reduction in staff numbers would have a detrimental effect on service provision, particularly front line services such as street cleaning.  She added that it would be useful to carry out an audit of services to establish where there might be areas of concern.  Councillor O’Donnell stated that any analysis would need to be mindful that senior staff are leaving the service and that remaining staff cannot be promoted to fill the subsequent gaps.

 

Mr Hunter McGowan stated that the executive shared the concerns of the members in relation to maintaining service provision.  He added that over 100 staff had now left Kildare County Council and no students had been employed over the summer months. Consideration was currently being given to redeploying staff to ensure that service levels can be maintained.  In this regard some staff members would be mobile and this would be a feature of future service provision.  The County Manager stated that more difficulties could be encountered in the future, but for the moment gaps would be filled through redeployment, where possible. 

 

Councillor Griffin requested that information be made available to the Councillors including number of current employees, number of employees on contracts, number of employees on secondment and number of expected retirements.

Mr Skehan advised that a report had been prepared in response to the motion.  Councillor Murphy requested that the report be circulated and that this item be listed again for the next meeting of the Council.

Any Other Business

 

The Mayor and members wished former Councillor Jimmy O’Loughlin a speedy return to health following his recent illness.

 

Councillor Lawlor requested that reports be e-mailed to members rather than supplied in hard copy.  The County Manager agreed that he would like to see more documents being circulated electronically reducing the need for paper copies.  It was agreed that this matter would be discussed further with the Corporate Policy Group.
