MATERIAL CONTRAVENTION OF KILDARE COUNTY DEVELOPMENT PLAN 2005-2011and KILDARE COUNTY DEVELOPMENT PLAN 2011-2017

Notice is hereby given in accordance with Section 34 (6) of the Planning and Development Acts 2000-2010 that Kildare County Council intends to consider deciding to grant permission to Future Pigs Limited for a development proposed under Planning reference 10/846 for planning permission on a site of c. 11.17 hectares (27.601 acres) at Gorteen Lower, Nurney, Co. Kildare.

The development applied for is (a) to modify the existing entrance to improve sightlines and (b) to increase the quantity of imported organic biomass to 23000 tonnes from that granted in planning ref No. 09/1058. The application is accompanied by an Environmental Impact Statement.

The development would contravene materially Section 6.7.6, Policy OD1 of the Kildare County Development Plan 2005-2011 and by Section 10.5.1, Policy RRD11, of the Kildare County Development Plan 2011 – 2017 which state:

OD1 Apart from housing development, there are other land uses which may be considered in the rural countryside. Where an area is not within an identifiable settlement and is not otherwise zoned as part of this development plan, or of any of the town development plans, the use of such land will be deemed to be primarily agricultural.

RRD 11: Apart from rural housing as provided for in Chapter 4, there are other land uses which may be considered in the rural countryside. Where an area is not within an identifiable settlement, and is not otherwise zoned as part of this Plan, or of any of the town development plans, the use of such land shall be deemed to be primarily agricultural.

Particulars of the development may be inspected at the offices of the Planning Department of Kildare County Council, Aras Chill Dara, Devoy Park, Naas, Co Kildare, during office hours (9 a.m. to 4 p.m., Monday to Friday). Any submission or observation regarding the making of a decision to grant permission received not later than 5.00 p.m. the 27 May 2011 will be duly considered by the Planning Authority.
