Variation No. 3 of the Kildare County Development Plan 2011-2017 as made by the Council on 20October, 2014

Draft Direction in the matter of section 31 of the Planning and Development Act 2000 (as amended)

TAKE NOTICE THAT:

On 12 November, 2014 the Minister for the Environment, Community and Local Government notified Kildare County Council of his intent to issue a Direction pursuant to Section 31 of the Planning and Development Act 2000 (as amended). The draft Ministerial Direction relates to Variation No. 3 to the County Kildare Development Plan 2011 – 2017.

The reasons given for the draft Direction are:

  • A written submission on the proposed material alterations to Variation No. 3 of the Kildare County Development Plan 2011 – 2017 was made to Kildare County Council on behalf of the Minister for the Environment, Community and Local Government in September 2014.
  • The written submission outlined that the proposed amendments to the proposed variation to include provisions to address high tension power lines are[m1] contrary to national policy as set out by[m2] the Minister for Communications, Energy and Natural Resources in relation to Transmission and Energy Infrastructure.
  • The Planning Authority has ignored, or has not taken sufficient account of the said written submission, in that the Planning Authority proceeded to adopt a policy objective which would be inconsistent with national Government policy.

The decision by the members to alter the policy in regard to the Energy and Communications objectives as outlined in this direction do not provide for proper planning and sustainable development and therefore the Kildare County Development Plan 2011-2017 (as varied) is not in compliance with the requirements of Section 13 of the Planning and Development Act, 2000 (as amended).

A copy of the draft Direction may be inspected at

  • Kildare County Council, Planning Department, Level 1, at the address below from Monday to Friday, excluding public holidays, from 9.00 am to 4.00 pm
  • The website: www.kildarecountycouncil.ie
  • All branches of Kildare libraries during normal library opening hours

for a period of 2 weeks from the 24 November 2014 to 8 December 2014.

Written submissions or observations in respect of the draft Direction may be made to the Planning Authority during the stated period and shall be taken into consideration by the Minister before he directs the Planning Authority pursuant to this section.

The closing date for receipt of submissions is 5.00 p.m. on Monday 8 December, 2014.
